HomeMy WebLinkAbout11162City Clerk's Office Item # S19 Background Paper for Proposed Action Item COUNCIL MEETING DATE: April 27, 2026 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Clyde Bishop, City Clerk FROM: Chris Noeller, Chief of Police SUBJECT: AN ORDINANCE APPROVING AND AUTHORIZING THE MAYOR TO SIGN A SUBRECIPIENT AGREEMENT BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND PUEBLO SCHOOL DISTRICT NO. 60, A PUBLIC SCHOOL DISTRICT AND POLITICAL SUBDIVISION OF THE STATE OF COLORADO, AND AUTHORIZING THE PAYMENT OF AMOUNTS FROM FUND NO. 226 - OPIOID ABATEMENT SETTLEMENT, FOR THE PURPOSES THEREOF SUMMARY: This agreement will distribute available amounts in Fund No. 226, not to exceed the maximum amount of $600,000 over the course of 3 school years ($200,000 per year) to Pueblo School District No. 60 to fund the employment of two Intervention Coordinators to conduct school -based programs to prevent opioid and drug misuse and to conduct school and community education programs and campaigns. PREVIOUS COUNCIL ACTION: Ordinance No. 10472 (June 12, 2023) approved a similar agreement to fund one Intervention Coordinator in the amount of $300,000 over the course of two school years ($150,000 per year). Ordinance No. 10927 (April 14, 2025) approved an amendment and extension of the agreement for the 2025-2026 school year and funded the employment of two Intervention Coordinators in the amount of $200,000 for the school year. BACKGROUND: In August 2021, the Colorado Attorney General announced a plan for distributing opioid settlement funds obtained from a number of settlements with major drug manufacturers and distributors. The City chose to opt into receiving these settlement funds, and to opt out of putting the City of Pueblo's funds into a regional pot for broader use, electing to take the funds to ensure specific use within the City itself. To date, the Opioid Fund has a fund balance of $975,594.78. Under the agreement, the Intervention Coordinator positions shall advance approved purposes for use of such settlement funds, including through, but not limited to: (i) creating a school -based contact who parents can engage to seek immediate treatment services for their child; (ii) assisting with community -wide stigma reduction; (iii) conducting school -based programs that have demonstrated effectiveness in preventing drug misuse and seem likely to be effective in preventing the uptake and use of opioids; and (iv) conducting school and community education programs and campaigns for students, families, school employees, school athletic programs, parent -teacher and student associations, and others. FINANCIAL IMPLICATIONS: Funding received directly from the Opioid Settlement will be used for this project; this program falls under proper intended use. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Discussions between the City and District 60 took place to pinpoint the best method for targeting programs to youth for prevention education; this position was the outcome. ALTERNATIVES: Funding could be diverted elsewhere for other "Approved Purposes" in keeping with the possible uses for Opioid Abatement Settlement Funds. RECOMMENDATION: Passage of the Ordinance. ATTACHMENTS: None ORDINANCE NO. 11162 AN ORDINANCE APPROVING AND AUTHORIZING THE MAYOR TO SIGN A SUBRECIPIENT AGREEMENT BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND PUEBLO SCHOOL DISTRICT NO. 60, A PUBLIC SCHOOL DISTRICT AND POLITICAL SUBDIVISION OF THE STATE OF COLORADO, AND AUTHORIZING THE PAYMENT OF AMOUNTS FROM FUND NO. 226 - OPIOID ABATEMENT SETTLEMENT, FOR THE PURPOSES THEREOF BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. The Subrecipient Agreement ("Agreement") between the City of Pueblo, a Colorado Municipal Corporation, and Pueblo School District No. 60, a public school district and political subdivision of the State of Colorado, a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The Mayor is hereby authorized to execute said Agreement for and on behalf of the City and the City Clerk is authorized to affix the seal of the City thereto and attest same. SECTION 3. Funds in an amount not to exceed $600,000.00, to be disbursed over the three (3) year term of the Agreement, are hereby authorized to be paid from Fund No. 226 - Opioid Abatement Settlement in accordance with the Agreement, for purposes of the Intervention Coordinator position. SECTION 4. The officers and staff of the City are authorized to perform any and all acts consistent with this Ordinance and the attached Agreement to implement the policies and procedures described herein. SECTION 5. This Ordinance shall become effective on the date of final action by the Mayor and City Council. Action by City Council.
