SUBJECT: AN ORDINANCE APPROVING A DONATION AGREEMENT BETWEEN
THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION,
AND BAXTER KIRKLAND AND BRIANNA KIRKLAND, AND
AUTHORIZING THE MAYOR TO EXECUTE SAME
SUMMARY:
This Ordinance approves a Donation Agreement between the City of Pueblo and Baxter
Kirkland and Brianna Kirkland outlining terms and conditions related to a private donation
for the Sky Corral Runway Relocation Project.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
With Pueblo County's recent project to construct Medal of Honor Boulevard connecting
Joe Martinez Boulevard in Pueblo West to Pueblo Boulevard, the City -owned remote
control aircraft runway facility located on the Honor Farm property on the west side of
the City must be relocated to ensure the safe operation of remote control aircraft at the
facility. Baxter Kirkland and Brianna Kirkland have expressed their intent to provide a
donation of $100,000.00 towards the project. The Donation Agreement being approved
by this Ordinance outlines terms and conditions between the parties related to the
donation.
FINANCIAL IMPLICATIONS:
Under the Agreement, Baxter Kirkland and Brianna Kirkland will make a donation of
$100,000.00 towards the project. Once the Agreement is approved and executed, a
separate Ordinance will be presented to City Council to accept the donation and to
budget and appropriate the funds into the appropriate project account.

Not applicable to this Ordinance.
STAKEHOLDER PROCESS:
Not applicable to this Ordinance.
ALTERNATIVES:
Failure to approve the Ordinance will prevent the City from entering into the Agreement
with the Kirklands.
RECOMMENDATION:
Approval of the Ordinance.

KIRKLAND, AND AUTHORIZING THE MAYOR TO EXECUTE
SAME
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:.
SECTION 1.
The Donation Agreement between the City of Pueblo, a Colorado Municipal Corporation,
and Baxter Kirkland and Brianna Kirkland, a copy of which is attached hereto (hereinafter referred
to as the "Agreement"), having been approved as to form by the City Attorney, is hereby approved.
SECTION 2.
The Mayor is authorized to execute and deliver the Agreement in the name of the City of
Pueblo and the City Clerk is directed to affix the seal of the City thereto and attest same.
SECTION 3.
The officers of the City are authorized to perform any and all acts consistent with this
Ordinance and the Agreement to implement the policies and procedures described therein.
SECTION 4.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.
