SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS TO REZONE
502 AND 504 CHERRY LANE FROM B-3, HIGHWAY AND ARTERIAL
ZONE DISTRICT TO R-3, ONE- AND TWO-FAMILY RESIDENTIAL
ZONE DISTRICT
SUMMARY:
The applicant is requesting to rezone .22-acres from B-3, Highway and Arterial Zone
District to an R-3, One- and Two -Family Residential Zone District to facilitate the
construction of a residential duplex.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
The application is requesting to rezone the undeveloped .22-acre lot from a Highway and
Arterial Business (B-3) Zone District to One- and Two -Family Residential (R-3) Zone
District to facilitate development of a duplex. The subject property is located on the
southeast corner of Thatcher Ave and Cherry Ln near the Goodnight Elementary School
and Park. It is an undeveloped 0.22-acre lot which will gain access from Cherry Lane.
The proposed site plan meets the R-3 Zone District Requirements and shows the duplex
taking access from Cherry Lane. The surrounding neighborhood consists of a mixture of
commercial and single-family residential development. The 2022 Regional
Comprehensive Plan designates the subject property and surrounding area as a
Suburban Neighborhood. The Suburban Neighborhood is characterized by single-family
detached and attached homes, accessory dwelling units, townhomes, and duplexes
supported by complimentary uses such as neighborhood -scale goods and services,
parks, schools, and community gardens. The R-3 Zone District allows for the low- and
medium -density residential development called for by the Regional Plan in the Suburban
Neighborhood.
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.
I OARDICOMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their March 11, 2026, Regular Meeting, voted
7-0 to recommend approval.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission Public
Hearing to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public
Hearing.
ALTERNATIVES:
If City Council does not approve this Ordinance the property will not be re -zoned to allow
a residential duplex use.
Upon request of City Council, the Ordinance could be returned to the Planning and
Zoning Commission for consideration of proposed modifications.
RECOMMENDATION:

BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that.
SECTION 1.
The zoning restrictions covering the following described property, and in addition half of
all adjacent dedicated roadway and alley rights -of -way, together generally identified in the
attached Rezone Exhibit, is hereby changed from B-3, Highway and Arterial Business District to
R-3, One- and Two -Family Residential Zone District:

SECTION 2.
The officers and staff of the City are authorized to perform any and all acts consistent with
the intent of the Ordinance to implement the policies and procedures described herein.
SECTION 3_
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.
