ORDINANCE NO. 11140
AN ORDINANCE APPROVING A QUIT CLAIM DEED BETWEEN
THE CITY OF PUEBLO, A COLORADO MUNICIPAL
CORPORATION AND GOODNIGHT BARN HISTORIC
PRESERVATION, INC. TRANSFERRING CITY -OWNED
PROPERTY AND AUTHORIZING THE MAYOR TO EXECUTE
SAME
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1
The City Council hereby finds and concludes that the land described in Exhibit A of this
Ordinance and the proposed Quit Claim Deed, commonly known as the Goodnight Barn Property,
may be transferred without detriment to the City. The Quit Claim Deed, dated February 23, 2026,
between the City and Goodnight Barn Historic Preservation, Inc. a copy of which is attached
hereto and incorporated herein by this reference, having been approved as to form by the City
Attorney, is hereby approved.
SECTION 2.
The Mayor is hereby authorized to execute and deliver the Quit Claim Deed in the name
of the City of Pueblo and the City Clerk is directed to affix the seal of the City thereto and attest
same.
SECTION 3.
The officers and staff of the City are directed and authorized to perform any and all acts
consistent with the intent of this Ordinance and the attached Quit Claim Deed which are necessary
or desirable to effectuate the transaction described therein.
SECTION 4.
This Ordinance shall become effective immediately upon final passage

TRANSFERRING CITY -OWNED PROPERTY AND AUTHORIZING THE
MAYOR TO EXECUTE SAME

This Ordinance approves the transfer via Quit Claim Deed for land described as a
portion of Parcel B in Subdivision Exemption No. 2003-006, County of Pueblo, State of
Colorado — commonly known as the Goodnight Barn property.
PREVIOUS COUNCIL ACTION:
The City of Pueblo purchased the Goodnight Barn property from Continental Materials
Corporation via Resolution 10109 in 2004.
BACKGROUND:
The Goodnight Barn property was purchased using several sources of grant funding,
including a grant containing a requirement subjecting this property to a conservation
easement.
Goodnight Barn Historic Preservation, Inc. has managed the barn pursuant to an
agreement with the City since 2021. Goodnight Barn Historic Preservation, Inc., is a
Colorado nonprofit corporation which has operated, promoted, managed, maintained,
and preserved the property in accordance with the terms of the conservation easement
upon the property.
The transfer of this encumbered property to this nonprofit would eliminate the City's
maintenance expenses for the property. The transfer would also enable the nonprofit to
more easily obtain financing to further its preservation and restoration efforts.
FINANCIAL IMPLICATIONS:
If approved, the transfer of the property would eliminate the City's maintenance
expenses for the property.
BOARD/COMMISSION RECOMMENDATION:
Not applicable to this Ordinance.
STAKEHOLDER PROCESS:
Not applicable to this Ordinance.
ALTERNATIVES:
If this Ordinance is not approved, the City will retain ownership of this property subject
to the easement.
RECOMMENDATION:
Approval of the Ordinance.
