LD ZN ro The City Council hereby finds and concludes that the unimproved land described in ro o ; Exhibits "A" and "B" of the Quit Claim Deed may be transferred without detriment to the City. I Transportation, State of Colorado ("CDOT"), a copy of which is attached hereto and incorporated G M= herein by this reference, having been approved as to form by the City Attorney, is hereby NaU approved. SECTION 2. The Mayor is hereby authorized to execute and deliver the Quit Claim Deed in the name of the City of Pueblo and the City Clerk is directed to affix the seal of the City thereto and attest same. SECTION 3. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance and the attached Quit Claim Deed which are necessary or desirable to effectuate the transaction described therein. SECTION 4. This Ordinance shall become effective immediately upon final passage. Introduced and initial adoption of Ordinance by City Council on February 23, 2026. PREVIOUS COUNCIL ACTION: None. BACKGROUND: The subject property is located within the Eastwood Re -Sub subdivision. The property contains an area of approximately 8,300 square feet. This property was once owned by CDOT and used for right-of-way and access to US Highway 50 Bypass. The highway has since been reconstructed and this access closed. CDOT determined that this property was surplus and deeded it to the City via Quit Claim Deed dated November 28, 2012, and recorded December 12, 2012, at Reception #1927988. CDOT conveyed the property to the City with a deed restriction reverting ownership back to CDOT if the land is not used for public transportation purposes. Because of this restriction, the land has no marketable value to the City, and the City may not sell or otherwise transfer the property with quiet title except to CDOT. Docusign Envelope ID: EC2FE01 F-9AC8-4668-9482-497F980E110E The property owner at 2609 E. 8th Street has requested that the city owned property adjacent to, be deemed as surplus property for possible purchase via competitive bid. This Quit Claim Deed will revert the property to CDOT who will in turn work with the said property owner for future transfer of ownership. FINANCIAL IMPLICATIONS: If approved, there are no direct financial implications to the City associated with transfer of the property. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: If this Ordinance is not approved, the City will retain ownership of this property; however, CDOT may choose to initiate action to recover the property.
