HomeMy WebLinkAbout11123 City Clerk's Office Item # S4 Background Paper for Proposed Ordinance COUNCIL MEETING DATE: February 23, 2026 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Andrew Hayes, Public Works Director SUBJECT: AN ORDINANCE APPROVING A MODIFICATION TO THE SUPPLEMENTAL ENVIRONMENTAL PROJECT (SEP) AGREEMENT BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND THE COLORADO DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT FOR THE PURPOSE OF DEVELOPING A HOUSEHOLD HAZARDOUS WASTE PROGRAM, AND AUTHORIZING THE MAYOR TO EXECUTE THE MODIFICATION SUMMARY: This proposed Ordinance approves a modification to the Supplemental Environmental Project (SEP) Agreement between the City of Pueblo and the Colorado Department of Public Health and Environment (CDPHE) dated January 30, 2023, and authorizes the Mayor to execute the modification. PREVIOUS COUNCIL ACTION: City Council approved Ordinance No. 10761 on August 26, 2024, approving and ratifying the Supplemental Environmental Project Agreement and an amendment to the Agreement and accepting, budgeting, and appropriating funds for the project. BACKGROUND: The City has requested to modify the project work plan (schedule) related to the Supplemental Environmental Project (SEP). This Ordinance will formalize a modification to the original agreement to update the specific task due dates and extend the final project completion deadline to January 31, 2029. FINANCIAL IMPLICATIONS: None. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: Failing to approve this Ordinance will preclude the City of Pueblo from modifying the project schedule and place the City out of compliance with the current agreement. RECOMMENDATION: Recommend approval of this Ordinance. ATTACHMENTS: 1. The Modification to the Supplemental Environmental Project (SEP) Agreement between the City of Pueblo, a Municipal Corporation, and the Colorado Department of Public Health and Environment, relating to the establishment of a Household Hazardous Waste Collection program ("Modification"), a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The Mayor is authorized to execute and deliver the Modification in the name of the City. SECTION 3. The officers of the City are authorized to perform any and all acts consistent with this Ordinance and Modification to implement the policies and procedures described herein. Furthermore, all actions previously taken by officers and staff of the City consistent with the agreement are hereby ratified. SECTION 4. This Ordinance shall become effective on the date of final action by the Mayor and City Council.
