HomeMy WebLinkAbout16254 City Clerk's Office Item # Q4 Background Paper for Proposed Resolution COUNCIL MEETING DATE: February 9, 2026 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Harley Gifford, Deputy City Attorney SUBJECT: A RESOLUTION FROM THE CITY OF PUEBLO IN SUPPORT OF COLORADO HOUSE BILL 26-1071, CONCERNING ALLOWING A LOCAL GOVERNMENT TO LOCATE AN AUTOMATED VEHICLE IDENTIFICATION SYSTEM ON AN INTERSTATE HIGHWAY SUMMARY: Attached is a Resolution in support of Colorado House Bill 26-1071 concerning allowing a local government to locate an automated vehicle identification system on an interstate highway. PREVIOUS COUNCIL ACTION: Not applicable to this Resolution. BACKGROUND: Current law allows the state to locate an automated vehicle identification system (AVIS) on a highway that is part of the federal interstate highway system but prohibits a county, city and county, or municipality (local government) from doing so. The bill authorizes local governments to locate an AVIS on a highway that is part of the federal interstate highway system. FINANCIAL IMPLICATIONS: There are no financial implications for the City in passing this Resolution. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Resolution. STAKEHOLDER PROCESS: Not applicable to this Resolution. ALTERNATIVES: City Council could choose not to publicly support Colorado House Bill 26-1071. RECOMMENDATION: Approval of the Resolution. HB 26-1071 RESOLUTION NO. 16254 A RESOLUTION FROM THE CITY OF PUEBLO IN SUPPORT OF COLORADO HOUSE BILL 26-1071, CONCERNING ALLOWING A LOCAL GOVERNMENT TO LOCATE AN AUTOMATED VEHICLE IDENTIFICATION SYSTEM ON AN INTERSTATE HIGHWAY WHEREAS, Automated Vehicle Identification Systems (AVIS) utilize cameras and sensors to automatically detect traffic violations, such as speeding and red light violations, and record vehicle data like license plates for penalty issuance; and WHEREAS, AVIS is used in many Colorado municipalities to enhance road safety near schools, construction zones, municipal parks and residential neighborhoods; and WHEREAS, AVIS is a tool which can be leveraged to change people's behavior, to make and WHEREAS, state law currently restricts all municipalities from locating an AVIS or establishing an AVIS corridor on any highway that is part of the federal highway interstate system; and WHEREAS, Colorado House Bill 26-1071 will remove the current restriction regarding placement of an AVIS on federal highway interstate system highways and allow the Pueblo Police Department to enhance road safety along Interstate 25 through the City of Pueblo; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. The City Council of the City of Pueblo, for the above-stated reasons, supports the passage of Colorado House Bill 26-1071 and urges the Colorado State Legislature to enact the same. SECTION 2. A copy of this Resolution be transmitted to all members of the Colorado General Assembly and the Governor of Colorado. SECTION 3. The officers and staff of the City are authorized to perform any and all acts consistent with this Resolution to effectuate the policies and procedures described herein. SECTION 4. This Resolution shall become effective immediately upon final passage and approval.
