EXECUTE A CONTRACT TO BUY AND SELL REAL ESTATE BY AND
BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL
CORPORATION, AND STANLEY RIVERA AND ALVIN RIVERA
PARTNERSHIP, FOR THE PURCHASE OF THE PROPERTY
DESCRIBED AS 316-322 WEST NORTHERN AVENUE WITHIN THE
CITY OF PUEBLO, AND BUDGETING AND APPROPRIATING FUNDS
IN THE AMOUNT OF $99,000 FROM PROJECT CI2113 ARPA
INTEREST FUNDS TO PROJECT CI2526 316-322 W NORTHERN
PURCHASE FOR THE PURCHASE
SUMMARY:
Attached for consideration is an Ordinance authorizing the Mayor to execute a Contract
to Buy and Sell Real Estate between the City of Pueblo and Stanley Rivera and Alvin
Rivera Partnership for the property at 316-322 West Northern
and in furtherance of the purchase, accepts the deed for the Property.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
The Property has been vacant for many years and is in a state of serious disrepair. It is
an attractive nuisance for vagrants and criminal behavior, which creates an unsanitary
and unsafe condition to the public. The Property contributes to blight in this area. The
City desires to purchase the building so that it can be rehabilitated or
repurposed. Reducing blight, encouraging development, and helping to renew this area
of the City will protect the public, public health, safety, welfare and serve a public
purpose.
The Contract to Buy and Sell Real Estate allows the City ninety (90) days to inspect the
property and perform any environmental testing deemed prudent. The Contract provides
for a closing date at the end of ninety (90) days. No earnest money is required to secure
the sale.
FINANCIAL IMPLICATIONS:
If approved, the City will transfer $99,000 from Project CI2113 ARPA Interest Funds to
Project CI2526 316-322 W Northern Purchase to be paid to the Seller at closing.
BOARD/COMMISSION RECOMMENDATION:
Not applicable to this Ordinance.
STAKEHOLDER PROCESS:
Not applicable to this Ordinance.
ALTERNATIVES:
City Council could decide not to pass the attached Ordinance and thus, not purchase the
Property.
RECOMMENDATION:
Approval of the Ordinance.

WHEREAS, the property located at 316-

condition to the public; and
WHEREAS, the Property contributes to the blight in this area and it is in the best interest
of the health, safety, and welfare of the public to purchase and rehabilitate the Property; and
WHEREAS, the elimination of blight and slum conditions is a proper public purpose; NOW,
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Contract to Buy and Sell Real Estate ("Contract") between the City of Pueblo, a
Colorado Municipal Corporation, and Stanley Rivera and Alvin Rivera Partnership for the property
at 316-
been approved as to form by the City Attorney, is hereby approved. The Mayor is hereby
authorized to execute said Contract and accept the deed for and on behalf of the City of Pueblo
and the City Clerk's Office is authorized to affix the seal of the City thereto and attest same.
SECTION 2.
The officers and staff of the City are authorized to perform any and all acts consistent with
the intent of this Ordinance and the attached Contract to effectuate the policies and procedures
described therein.
SECTION 3.
This Ordinance shall become effective immediately upon the date of final action by the
City Council and the Mayor.

Final adoption of Ordinance by City Council on January 12, 2026.
