HomeMy WebLinkAbout11109 City Clerk's Office Item # S14 Background Paper for Proposed Ordinance COUNCIL MEETING DATE: January 12, 2026 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Andrew Hayes, Public Works Director SUBJECT: AN ORDINANCE APPROVING A CDOT ACCESS PERMIT AGREEMENT BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND MARTINEZ PROPERTY HOLDINGS, INC., A NEW MEXICO CORPORATION, AND AUTHORIZING THE MAYOR TO EXECUTE SAME SUMMARY: This Ordinance approves a CDOT Access Permit Agreement establishing developer obligations for installation of public improvements along Pueblo Boulevard. PREVIOUS COUNCIL ACTION: None. BACKGROUND: Martinez Property Holdings, Inc. is the owner and developer of properties located on the north side of Pueblo Boulevard near Mirror Avenue. As a condition of development, the Colorado Department of Transportation (CDOT) is requiring the installation of certain highway improvements on Pueblo Boulevard including traffic signals, acceleration and deceleration lanes, raised concrete median, striping, signage, and other improvements. CDOT has issued an access permit to the City requiring these improvements be installed prior to development and this agreement passes the obligations through to the developer. FINANCIAL IMPLICATIONS: There is no direct financial impact to the City resulting from entering into this agreement. The developer will incur the obligation to install the required public improvements as part of the site development project. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: Failure to pass this Ordinance will preclude the City from entering into the agreement with the developer. Exhibit A - CDOT Access Permits (Mirror-Acero) ORDINANCE NO. 11109 AN ORDINANCE APPROVING A CDOT ACCESS PERMIT AGREEMENT BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND MARTINEZ PROPERTY HOLDINGS, INC., A NEW MEXICO CORPORATION, AND AUTHORIZING THE MAYOR TO EXECUTE SAME BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The CDOT Access Permit Agreement between the City of Pueblo, a Colorado Municipal Corporation, and Martinez Property Holdings, Inc., a New Mexico Corporation, a copy of which is attached hereto ("Agreement"), having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The Mayor is authorized to execute and deliver the Agreement in the name of the City of Pueblo and the City Clerk is directed to affix the seal of the City thereto and attest same. SECTION 3. The officers of the City are authorized to perform any and all acts consistent with this Ordinance to implement the policies and procedures described herein. SECTION 4. This Ordinance shall become effective on the date of final action by the Mayor and City Council.
