HomeMy WebLinkAbout11094 City Clerk's Office Item # S4 Background Paper for Proposed Ordinance COUNCIL MEETING DATE: December 22, 2025 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Carla Sikes, City Attorney SUBJECT: AN ORDINANCE APPROVING A SETTLEMENT AGREEMENT BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION AND PUEBLO COUNTY, A POLITICAL SUBDIVISION OF THE STATE OF COLORADO FOR THE TERMINATION AND DISSOLUTION OF THE PUEBLO REGIONAL BUILDING DEPARTMENT SUMMARY: Attached is an Ordinance approving a settlement agreement between the City of Pueblo and Pueblo County relating to the termination and dissolution of the Pueblo Regional Building Department. PREVIOUS COUNCIL ACTION: On October 22, 2012, City Council approved Ordinance No. 8525 approving an Amended and Restated Agreement between the City of Pueblo, a municipal corporation and the Board of County Commissioners of the County of Pueblo creating the Pueblo Regional Building Department. BACKGROUND: On October 22, 2012, City Council approved Ordinance No. 8525 approving an Amended and Restated Agreement between the City of Pueblo, a municipal corporation and the Board of County Commissioners of the County of Pueblo for the creation of the -1- 203. Pursuant to its terms, the Amended and Restated Agreement continued from year- to- notice of its intention to terminate at least six months before the end of the calendar year with such termination On June 27, 2025, Pueblo County provided the City with written notice of its intention to terminate the Amended and Restated Agreement. Such termination shall be effective on December 31, 2025. The attached Settlement Agreement provides for the distribution of assets, allocation of liabilities, and separation of records to allow for a smooth transition to independent and separate building departments. The Settlement Agreement resolves all remaining issues between the City and Pueblo County related to the Pueblo Regional Building Department. Pueblo Regional Building Department will cease to exist as of midnight on December 31, 2025. Pueblo County will take over all new and pending plan reviews, permits, and inspections for Pueblo County beginning January 1, 2026. The Southern Colorado Building Department will process all new permits and pending plan reviews, permits, and inspections for the City of Pueblo and Town of Boone beginning January 1, 2026. FINANCIAL IMPLICATIONS: A settlement payment in the amount of $2,420,958.70 will be paid to Pueblo County from the current Pueblo Regional Building Department reserves. This amount reflects the BOARD/COMMISSION RECOMMENDATION: None. STAKEHOLDER PROCESS: None. ALTERNATIVES: City Council could reject the Settlement Agreement. RECOMMENDATION: Approval is recommended. The Settlement Agreement by and between the City of Pueblo, a Colorado Municipal Corporation and Pueblo County, a political subdivision of the State of Colorado relating to the termination and dissolution of the Pueblo Regional Building Department, a copy of which is attached hereto and incorporated herein by this reference, having been approved as to form by the City Attorney, is hereby approved. The Mayor is authorized to execute and deliver said Settlement Agreement in the name of the City and City Clerk is directed to affix the seal of the City thereto and attest the same. SECTION 2. The officers of the City are authorized to perform any and all acts consistent with this Ordinance and the attached Settlement Agreement which ae necessary or appropriate to implement the same. SECTION 3. This Ordinance shall become effective on the date of final action by the Mayor and City Council.
