HomeMy WebLinkAbout16201 City Clerk's Office Item # M8 Background Paper for Proposed Resolution COUNCIL MEETING DATE: December 22, 2025 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Mark Guerro, Director Regional Building Department Chad Wolgram, Pueblo Department of Public Health and Environment SUBJECT: A RESOLUTION OPTING OUT OF HOUSE BILL 24-1363 CONCERNING MEASURES TO PROMOTE THE USE OF GRAYWATER SUMMARY: Attached is a Resolution resolving to opt-out of HB 24-1363 concerning measures to promote the use of graywater. PREVIOUS COUNCIL ACTION: Prior to HB 24-1363 City had to opt-in for the measures to promote the use of graywater. This new legislation requires governments to opt-out of the measures. City has traditionally sided on the opt-out option by not taking any measures to opt-in. BACKGROUND: In November of 2024 the Colorado Legislature approved House Bill 24-1362, which will take effect on January 1, 2026. HB 24-1362 is regarding measures to promote the use of gray water in the State of Colorado. This house bill allows residents in the State of Colorado to install graywater treatment systems for their homes or businesses in new construction projects. This house bill reverses an earlier version of a similar house bill ter systems in their jurisdictions. HB 24-1362 allows graywater systems by default unless the County systems by adopting a resolution to prohibit the use of graywater systems within their jurisdictions. The Pueblo Department of Public Health and Environment has met with representatives of local agencies, water systems, and wastewater treatment systems regarding this house bill according to 30-11-107 (1)(kk)(I) CRS to provide a recommendation to the elected officials of the County and City of Pueblo regarding graywater use in their respective jurisdictions. The local jurisdictions may adopt a resolution to prohibit the use of all graywater or prohibit one or more categories of graywater uses established by the Colorado Water Quality Control Commission adopted pursuant to Section 25-8-205(1)(g) CRS. FINANCIAL IMPLICATIONS: If City opts-out there is no financial implication. If we opt-in that there could be significant financial implications. If Pueblo County opts-out and City opts-in it will be a higher financial burden to City including an agency to inspect outside the house (outside of what Regional Building inspects) which City does not currently have. BOARD/COMMISSION RECOMMENDATION: The following entities have recommended opting out: Regional Building, Wastewater Department, Department of Health, Pueblo West Metro District (recommended by resolution) Public Works, and Board of Water Works. Pueblo County is currently contemplating a resolution to opt-out. STAKEHOLDER PROCESS: Not applicable. ALTERNATIVES: The City may refuse to adopt this resolution and would be required to comply with the new law and create new systems for managing graywater. RECOMMENDATION: Approval of the Resolution. City and County Graywater Recommendations RESOLUTION NO. 16201 A RESOLUTION OPTING OUT OF HOUSE BILL 24-1363 CONCERNING MEASURES TO PROMOTE THE USE OF GRAYWATER WHEREAS, the City does not possess the infrastructure to opt-in to the HB 24-1363 concerning measures to promote the use of graywater; WHEREAS, the City has no plans currently to create said infrastructure concerning graywater; WHEREAS, all entities impacted by this HB-24-1363 recommend opting out and City has traditionally opted out; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. City Council hereby resolves that City is opting out of HB 24-1363 and thus will not adopt any of the measures contained in that legislation. SECTION 2. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of this Resolution. SECTION 3. This Resolution shall become effective immediately upon final passage.
