HomeMy WebLinkAbout11059 City Clerk's Office Item # R2 Background Paper for Proposed Ordinance COUNCIL MEETING DATE: October 27, 2025 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Andrew Hayes, Public Works Director SUBJECT: AN ORDINANCE EXTENDING THE DEFERRED FILINGS PERIOD FOR THE MEMORIAL HEIGHTS SUBDIVISION TO MAY 31, 2026 SUMMARY: This ordinance extends the deferred filings period for the Memorial Heights subdivision until May 31, 2026. PREVIOUS COUNCIL ACTION: Ordinance No. 9995, which conditionally approved the Memorial Heights Subdivision was passed by City Council on August 23, 2021 and approved by the Mayor on August 24, 2021. BACKGROUND: The City received an application for resubdivision of properties located within the Central Pueblo, Hobson's, and Kretschmer's Subdivisions, respectively, in 2021. The subdivision plat was ultimately approved on August 24, 2021 under Ordinance No. 9995, with a condition that all required documentation supporting the subdivision be submitted and approved within one year of the ordinance being approved. That condition was not met and the ordinance is now in a "rescinded" status unless City Council takes action to affirmatively extend the deferred filings deadline for the subdivision through passage of an ordinance. The property owner has recently submitted the final documentation required for the subdivision and is requesting that the City record the subdivision plat and associated documents. In order to proceed with recording the subdivision documents, Council must authorize an extension to the deferred filings deadline specified in Section 12-4-8 (b) (2) of the Pueblo Municipal Code. FINANCIAL IMPLICATIONS: There are no direct financial implications to the City as a result of the passage and approval of this Ordinance. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: Failure to pass and approve this ordinance will prevent the City from recording the Memorial Heights subdivision plat and associated documents and the Director of Public Works will transmit written notice to the landowner that Ordinance No. 9995 has been repealed. This would require the landowner to submit a new subdivision application. RECOMMENDATION: Approval of the Ordinance ATTACHMENTS: None ORDINANCE NO. 11059 AN ORDINANCE EXTENDING THE DEFERRED FILINGS PERIOD FOR THE MEMORIAL HEIGHTS SUBDIVISION TO MAY 31, 2026 WHEREAS, City Council by Ordinance No. 9995, adopted August 23, 2021, conditionally approved the Memorial Heights Subdivision with the condition that all deferred filings be filed with and approved by the Director of Public Works within one year unless a time extension is granted by the City Council; and WHEREAS, the subdivider has requested such a time extension, submitted all deferred filing necessary to complete the subdivision process and has requested that the City record the subdivision plat and associated documents; and WHEREAS, additional action by City Council is required to extend the deadline for deferred filings to allow the Director of Public Works to record the subdivision plat and associated documents. NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The period for deferred filings pursuant to §12-4-5(b)(2), P.M.C., is extended through May 31, 2026 for the Memorial Heights Subdivision. SECTION 2. The officers of the City are authorized to perform any and all acts consistent with this Ordinance and the attached Agreement to implement the policies and procedures described herein. SECTION 3. This Ordinance shall become effective on the date of final action by the Mayor and City Council.
