HomeMy WebLinkAbout11058 City Clerk's Office Item # R1 Background Paper for Proposed Ordinance COUNCIL MEETING DATE: October 27, 2025 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Beritt Odom, Director Planning and Community Development SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS TO REZONE 151 NORTH BRADFORD AVENUE FROM B-3, HIGHWAY AND ARTERIAL BUSINESS ZONE DISTRICT TO R-6, MULTIPLE- RESIDENTIAL AND COMMERCIAL ZONE DISTRICT SUMMARY: The applicant is requesting to rezone 151 North Bradford Avenue from B-3, Highway and Arterial Business Zone District to R-6, Multiple-Residential and Commercial Zone District. PREVIOUS COUNCIL ACTION: None. BACKGROUND: The applicant is requesting to rezone the subject property from B-3, Highway and Arterial Business Zone District to R-6, Multiple Residential and Commercial Zone District to construct a billboard on the property. The subject property, commonly known as 151 North Bradford Ave, is a 0.30-acre undeveloped parcel adjacent to Interstate 25 at the nd intersection of North Bradford Street and East 2 Street. The subject property is currently in a Highway and Arterial Business (B-3) Zone District. The B-3 zone district is intended to provide areas along highways and arterial streets for a wide range of businesses and services. While the subject property is adjacent to I-25, it does not take access directly off the highway. Instead, vehicle and pedestrian access is provided from local streets. The B-3 Zone District does not allow for off-premises signage, including billboards. Should the property be rezoned to a Multiple-Residential and Commercial (R- 6) Zone District, the applicant could construct a billboard on the site once all required permitting from the City and CDOT is complete. The R-6 Zone District allows for fewer commercial land uses than the current B-3 zoning but would also allow the property to be used for one-family, two-family, and multifamily residential development. The R-6 district is a highway-oriented Zone District designed to retain and provide areas of mixed residence, commercial use, and accommodations for travelers. The subject property is designated by the 2022 Pueblo Regional Comprehensive Plan as Urban Neighborhood. Primary Land Uses in Urban Neighborhoods include moderate density residential, supporting land uses include neighborhood-scale commercial retail and service uses. The allowed residential and commercial uses in the R-6 Zone District are compatible with the Urban Neighborhood Future Land Use classification. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their September 10, 2025, Regular Meeting, voted 7-0 to recommend approval. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance the property will not be zoned in accordance with the Pueblo Municipal Code. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance. The zoning restrictions covering the following described property, and in addition half of all adjacent dedicated roadway and alley rights-of-way, together generally identified in the attached Rezone Exhibit, is hereby changed from B-3, Highway and Arterial Business Zone District to R-6, Multiple-Residential and Commercial Zone District: Lots 1 2 + NELY ½ OF LOT 3, BLOCK 14, PUEBLO SECTION 2. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of the Ordinance to implement the policies and procedures described herein. SECTION 3. This Ordinance shall become effective immediately upon final action by the Mayor and City Council.
