SUBJECT: AN ORDINANCE APPROVING A SPECIAL AREA PLAN FOR THE
TOWNHOMES AT RIVER'S RUN SUBDIVISION
SUMMARY:
The applicant is requesting establish a Special Area Plan for 9.384-acres to facilitate the
development of 133 townhomes. The townhome lots will have reduced lot widths,
setbacks, and be accessed from private streets.

Amendment, which is located north of Portland Avenue and west of South Norwood
Avenue. The proposed subdivision divides the property into 133 townhome lots, multiple
parcels for common area, sidewalks, landscaping, refuse, mail kiosks, clubhouse,
swimming pool, and private streets that will be owned, developed, and maintained by the
Rivers Run Flats Homeowners Association, Inc. A Special Area Plan is proposed for this
subdivision to allow for the unique development of private streets and attached
townhomes on individual lots, which do not meet the minimum standards for single-family
residences in a R-5 Zone District. Each townhome will be located on an individual lot and
will have a one car garage that is accessed from the private street. The townhome units
located at each end of the four-unit structure will have an additional surface parking
space complete with curb stop, in addition to the 18-foot-long driveway. The two middle
units only have a one-car garage and 18-foot-long driveway. All townhomes will have a
small fenced private yard which fronts onto a pedestrian path, located within parcels,
providing pedestrian circulation throughout the development. The proposed
development also includes drainage and detention parcels that will be landscaped.
Approximately 17 visitor parking spaces will be provided throughout the proposed
development, with seven spaces provided adjacent to the proposed clubhouse and
swimming pool. An additional 10 visitor parking spaces will be provided within Block 2 of
the subdivision, east of Rivers Run Avenue. Landscaping will be provided along the
entire periphery of the development. Residents will have the ability to utilize the
dedicated public park that is located within the northeastern portion of the Rivers Run
Subdivision, which is less than a quarter of a mile from the proposed development. The
proposed development is in an R-5, Multiple Residential and Office Zone District, which
requires a minimum lot width of 50 feet for single-family homes but does not provide
minimum standards for single-family attached townhomes located on individual lots.
Section 17-4-29, of the Pueblo Municipal Code states, in any zone district after or in
conjunction with approval of a subdivision plan, A Special Area Plan may be submitted
to the Planning and Zoning Commission for unique planning and development, which
may allow for exceptions to minimum setbacks and lot width and depth requirements for
each building, with consideration for the protection of public health, safety, and general
welfare. Therefore, the applicant is requesting approval of the proposed Special Area
Plan in conjunc

FINANCIAL IMPLICATIONS:
None.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their December 11th, 2024 Regular Meeting,
voted 5-0 to recommend approval, Commissioners Maestri and Pasternak absent.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission Public
Hearing to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public
Hearing.
ALTERNATIVES:
If City Council does not approve this Ordinance, the applicant will not be able to modify
lot lines to allow a rearrangement of property boundaries.
Upon request of City Council, the Ordinance could be returned to the Planning and
Zoning Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Ordinance.

WHEREAS,
Special Area Plan, has been submitted to the Planning and Zoning Commission for approval
pursuant to Section 17-4-29 of the Pueblo Municipal Code, and,
WHEREAS, the Planning and Zoning Commission after a public hearing found and
determined the objectives and requirements of said Section 17-4-29 can and will be met, and,
WHEREAS, the Planning and Zoning Commission has recommended the approval of the

QUARTER OF SECTION 31 AND A PORTION OF THE SOUTHWEST QUARTER OF SECTION
32, TOWNSHIP 20 SOUTH, RANGE 64 WEST OF THE SIXTH PRINCIPAL MERIDIAN, CITY
OF PUEBLO, PUEBLO COUNTY, COLORADO.
