HomeMy WebLinkAbout11043 City Clerk's Office Item # S3 Background Paper for Proposed Ordinance COUNCIL MEETING DATE: September 22, 2025 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Beritt Odom, Director Planning and Community Development SUBJECT: AN ORDINANCE AMENDING SECTION TWENTY-THREE OF CHAPTER FOUR OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO ACCESSORY BUILDINGS AND STRUCTURES SUMMARY: Attached for consideration is a text amendment that will update Chapter 4 of Title XVII of the Pueblo Municipal Code relating to architectural compatibility standards for attached accessory buildings and structures. PREVIOUS COUNCIL ACTION: None. BACKGROUND: As written, the Pueblo Municipal Code requires that all attached accessory structures all Through this text amendment, staff proposes that this strict compatibility requirement is overly prohibitive for certain attached accessory structures, specifically those structures that 1) have a roof pitch no greater than 2:12, 2) have no more than 3 enclosed sides, and 3) are placed to the side or rear of their principal structure. The roof material on structures with a maximum pitch of 2:12 is not visible at eye level; therefore, any nonmatching material on an accessory structure with that pitch would not disrupt the visual uniformity of a property. Additionally, common roofing materials for principal structures, namely shingles, can be both cost prohibitive and difficultif not structurally impossibleto install on structures with low-pitch roofs. By allowing flexibility in roof material, more property owners could develop their properties with desirable attached accessory structures. Considering this, staff posits that requiring such structures to intent of the accessory structure code by maintaining the visual aesthetics of the property while also making development of accessory structures more attainable for property owners. FINANCIAL IMPLICATIONS: There are no financial implications for the City BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their August 13, 2025 Regular Meeting, voted 7-0 to recommend approval. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing by publication of the proposed amendment fifteen (15) days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance, Title XVII of the Pueblo Municipal Code will not be amended to reflect the proposed change to compatibility standards for accessory buildings and structures. RECOMMENDATION: Approve the proposed Ordinance. ATTACHMENTS: 1. Section 17-4-23 (b) of the Pueblo Municipal Code is hereby amended to read as follows: Sec. 17-4-23. Accessory buildings and structures . . . (b) Attached accessory structures, including but not limited to private garages, carports, porches and decks, built as an integral part of the principal structure shall not be subject to size limitations, provided that they are smaller than the habitable portion of the principal structure. Attached accessory structures shall be attached to and shall not exceed the height of the principal structure. \[architecturally compatible with the principal structure, and shall not exceed the height of the principal structure.\] Attached accessory structures shall be architecturally compatible with the principal structure (as defined in Sec. 17-4-23 (c) (5) b.) unless they meet the following criteria, in which case only the color of the accessory structure must match or be complimentary to the principal structure: 1. The structure has a roof pitch no greater than 2:12, 2. The structure is enclosed on no more than three (3) sides, and 3. The structure is located to the side or the rear of the principal structure SECTION 2. The officers and staff of the City are authorized to perform any and all acts consistent with this Ordinance to implement the policies and procedures described herein. SECTION 3. This Ordinance shall become effective immediately after the date of final action by the Mayor and City Council.
