HomeMy WebLinkAbout11040 City Clerk's Office Item # R2 Background Paper for Proposed Ordinance COUNCIL MEETING DATE: September 22, 2025 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Beritt Odom, Director Planning and Community Development SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS TO REZONE 6201 AND 6205 SAWYER RIDGE DRIVE, LOTS 1-2, BLOCK 4, SAWYER RIDGE SUBDIVISION, FROM R-2, SINGLE FAMILY RESIDENTIAL ZONE DISTRICT TO R-2U, SINGLE FAMILY ZONE DISTRICT SUMMARY: The applicant is requesting to rezone 6201 and 6205 Sawyer Ridge Drive, Lots 1-2, Block 4, Sawyer Ridge Subdivision, from R-2, Single Family Residential Zone District to R-2U, Single Family Residential Zone District to facilitate the construction of two single family homes that utilize reduced front yard setbacks. PREVIOUS COUNCIL ACTION: None. BACKGROUND: The applicant is requesting to rezone 6201 (14,380 sq. ft.) and 6205 Sawyer Ridge Drive (13,849 sq. ft.) to an R-2U zone district to bring one existing home into compliance with setback requirements, and to facilitate the construction of one future home, allowing it to benefit from reduced front yard setbacks. The existing R-2 zone district requires a 25 ft. front yard setback while the R-2U zone district allows for an 18 ft front yard setback and 20 ft front yard setback to the garage from the back of the sidewalk (not the property line). The properties were subdivided and zoned R-2 in 2005, and in 2015 a large section of the Sawyer Ridge subdivision was rezoned to R-2U. The 2015 rezone followed an irregular pattern of lots, and it appears all undeveloped lots at that time were rezoned from R-2 to R-2U to allow for smaller homes and reduced setbacks. Lots 1 and 2, Block 4 are the only two lots that remained R-2 and the only lots north of Starboard Lane that were not rezoned R-2U. While there is no mention of a rationale for the R-2U rezoning pattern, staff did speak to Joe Gagliano who designed the subdivision. Mr. Gagliano believes Lot 1 and 2 were left zoned as R-2 because the original intent of Sawyer Ridge was large houses on large lots and both lots are larger than 13,800 sq. ft. 6205 Sawyer Ridge Drive has remained as an undeveloped lot. 6201 Sawyer Ridge Drive received a building permit in January of 2025 and was approved by staff with a reduced 18.8 ft. front yard setback from the garage to the property line. The home was completed in June of 2025 and during the final Certificate of Occupancy inspection staff noted the discrepancy, and that the home did not meet the 25-foot front yard setback, required by the R-2 Zone District. Staff spoke with the developer and discussed rezoning 6201 and 6205 Sawyer Ridge to a R-2 Zone District, to more closely match the development pattern within Block 4 of the Sawyer Ridge Subdivision. This would also bring 6201 Sawyer Ridge into compliance with R-2U front yard setbacks. The area to the south of Starboard Lane is zoned R-2 and represents larger lot development. The rest of the lots and homes to the north, east, and southeast are all zoned R-2U. Both lots meet the minimum lot width and sizes. The rezoning of Lots 1 and 2, Block 4, will create consistent zoning for all of Block 4 and allow more flexibility in the construction of the remaining lot. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their August 13, 2025, Regular Meeting, voted 7-0 to recommend approval. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance the property will not be zoned in accordance with the Pueblo Municipal Code. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance. The zoning restrictions covering the following described property, and in addition half of all adjacent dedicated roadway and alley rights-of-way, together generally identified in the attached Rezone Exhibit, is hereby changed from R-2, Single Family Residential Zone District to R-2U, Single Family Residential Zone District: Lots 1 and 2, Block 4 Sawyer Ridge Subdivision SECTION 2. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of the Ordinance to implement the policies and procedures described herein. SECTION 3. This Ordinance shall become effective immediately upon final action by the Mayor and City Council.
