HomeMy WebLinkAbout16131 _M14_ BACKGROUND PAPER FOR PROPOSED RESOLUTION COUNCIL MEETING DATE: September 22, 2025 TO: President Mark Aliff and Members of City Council CC:Mayor Heather Graham VIA:Marisa Stoller, City Clerk FROM:Beritt Odom, Director of Planning and Community Development SUBJECT:A RESOLUTION ADOPTING A FEE SCHEDULE FOR APPLICATIONS FOR MATTERS BROUGHT BEFORE THE LAND USE ADMINISTRATIVE OFFICIAL, HISTORIC PRESERVATION COMMISSION, PLANNING AND ZONING COMMISSION, SUBDIVISION REVIEW COMMITTEE, TECHNICAL ADVISORY COMMITTEE, AND ZONING BOARD OF APPEALS AND REPEALING RESOLUTION NO.15454 SUMMARY: This Resolution amends the Planning and Community Development Department fee schedule for matters brought before the land use administrative official and certain committees, boards, and commissions and repeals all previous Resolutions related to the fee schedule.The proposed Resolution and fee schedule updates the fees to reflect staff labor and review time, adjusting for inflation. Many of the current department fees have not been updated in over 20 years. This Resolution also adds fees for land use actions and applications that are new and that did not previously have a fee. PREVIOUS COUNCIL ACTION: City Council adopted the current fee schedule, Resolution No. 15454, on December 26, 2023. BACKGROUND: There are seven fees that were implemented in 2002 and 2003 that have not changed in the past twenty-two years. These include application fees for the construction of accessory structures (i.e., garages, carports, or sheds), review of commercial site plans, nomination of a historic district, rearrangement of property boundaries, residential construction, rezoning, and subdivision. The proposed fee schedule would increase these fees for the first time since implementation to amounts more appropriate for present day. For comparison, the Colorado Springs Planning Department, Development Review Enterprise Division charges $180 for new residential construction permits. This proposed $50. Similarly, the Colorado Springs Department charges $462 for a property boundary of property boundaries application fee from $125 to $200. All marijuana Conditional Use Permits (CUPS) will be standardized at $5000 regardless of type, and all marijuana CUP renewals will be $2500. They include applications for accessory dwelling units, commercial interior remodels, HARP development plan reviews, Master Sign Plans, public notice posters for the Historic Preservation Commission (HPC), public notices for annexation, special exceptions, special area plans, and swimming pools. The new fees mirror existing fees that require similar time and resources. The Department will also be able to collect new fees on items that would be added to the fee schedule. BOARD/COMMISSION RECOMMENDATION: Not applicable. STAKEHOLDER PROCESS: Not applicable. ALTERNATIVES: The current fee schedule will remain the same if the Resolution is not approved. No fees will be collected by the Planning and Community Development Department for the items that are proposed to be added to the schedule, even though said items will still be processed. Similarly, the fees that have not changed since 2002 and 2003 would remain unchanged. RECOMMENDATIONS: Approve the Resolution. The City of Pueblo is hereby exempt from the payment of fees established by this Resolution. SECTION 3. Resolution Number 15454 is hereby repealed as of September 22, 2025. SECTION 4. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of the Resolution to implement the policies and procedures described herein. SECTION 5. This Resolution shall become effective immediately upon final approval.
