A RESOLUTION APPROVING A RELEASE OF DRAINAGE
EASEMENTS WITH RESPECT TO RPB 24-03
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that
SECTION 1.
The Release of Easement, a copy of which is attached, having been approved as to form
by the City Attorney, is hereby approved.
SECTION 2.
The Mayor is authorized to execute and deliver the Release of Easement in the name of
the City. The City Clerk is directed to attest same, affix the seal of the City thereto and record the
executed and acknowledged Release of Easement together with a certified copy of this resolution
in the office of the Pueblo County Clerk and Recorder. The recording fees shall be paid for by
Atwater Pueblo Colorado, LLC.
SECTION 3.
The officers and staff of the City are authorized to perform any and all acts consistent with
the intent of this Resolution and the contract to implement the transactions described therein.
SECTION 4.
This Resolution shall become effective immediately upon passage and approval.

EASEMENTS WITH RESPECT TO RPB 24-03
SUMMARY:
This Resolution authorizes the release of 3 drainage easements whereas an alternate
drainage easement has been dedicated by separate instrument as part of the Tractor
Supply development.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
Three drainage easements located on Block 3, Lots 5, 6, and 7 were granted to the city
in 2007 for the purpose of stormwater detention in the Regency Business Park, LLC
Filing 1 subdivision. The property has since then rearranged into one singular lot under
RPB-24-03 and is now identified as Parcel A.
FINANCIAL IMPLICATIONS:
None.

None.

None.
ALTERNATIVES:
Alternatives No. 1 No action
Under this alternative, the drainage easements would remain in place and have no use.
RECOMMENDATION:
Approval of the Resolution.
