HomeMy WebLinkAbout16121 City Clerk's Office Item # M3 Background Paper for Proposed Resolution COUNCIL MEETING DATE: September 22, 2025 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Andra Ahrens, Director Wastewater SUBJECT: A RESOLUTION APPROVING AND AUTHORIZING THE PURCHASING AGENT TO EXECUTE AMENDMENT NO. 1 TO THE AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND BROWN AND CALDWELL, INC., IN THE AMOUNT OF $218,098 FOR PROJECT NO. 23-130, WASTEWATER DEPARTMENT ENGINEER OF RECORD DIGESTER COVERS AND MIXING SYSTEM REPLACEMENT, POLYMER SYSTEM REPLACEMENT AND PHASE 4 ELECTRICAL IMPROVEMENTS PROJECT SUMMARY: This Resolution approves Amendment No. 1 to the Professional Engineering Services Agreement awarded to Brown and Caldwell, Inc. in the amount of $218,098 for Project No. 23-130, Wastewater Department Engineer of Record Digester Covers and Mixing System Replacement, Polymer System Replacement and Phase 4 Electrical Improvements Project. PREVIOUS COUNCIL ACTION: Ordinance No. 9641 awarded an agreement between the City of Pueblo and Brown and Caldwell, Inc., for consulting engineering services to replace the headworks primary clarifier area control panels and motor control centers at the James R. DiIorio Water Reclamation Facility on January 20, 2020. On February 12, 2024, the City Council approved Resolution No. 15497, selecting Brown and Caldwell, Inc as the Engineer of Record for the Wastewater Department. September 10, 2024, the City Council approved Ordinance No. 10782 to have Brown and Caldwell Inc. design the digester covers and mixing system replacement, polymer system replacement and Phase 4 electrical improvements. BACKGROUND: The James R. DiIorio Water Reclamation Facility (WRF) treats all the wastewater for the City of Pueblo. The WRF will be upgrading the lids on digesters 3 and 4. The upgrade is required because the structures that allow the lids to float are beginning to fail, and new air quality regulations will require the lids to be updated to prevent methane from being released. The polymer system will be replaced because it is reaching the end of its useful life. This system is an integral part of the solids handling system. The electrical system will be upgraded to eliminate the use of fuses on the pole and to allow the electrical system to be reset without relying on the fuses that are on the electrical pole. This upgrade will allow WRF staff to reset the system without the necessity for a contractor to reset the system and leaving the WRF without power. The scope of work under the agreement shall include preliminary and final design and bid support with respect to the following items: 1. Digester mixing system replacement. 2. Replacement of two floating digester covers, including evaluation of new Colorado Air Quality requirements to guide direction for digester covers replacement. 3. Verification and revision of existing design documents for replacement of the polymer system. 4. Incoming electrical service improvements, elimination of existing fuses and installation of resettable protection devices on the incoming electrical service; and 5. Consolidation of design documentation with existing electrical improvements projects to create a single construction package. Amendment 1: Will include additional engineering design of Phase 5.1 electrical improvements efforts associated with replacing the digester complex motor control center and area control panel. Additional effort has also been included to design the installation of digester gas flowmeters, and additional efforts for the disciplines of Building Mechanical, Architectural, and Structural to satisfy code and standards requirements due to the increased amount of work in the electrical room. FINANCIAL IMPLICATIONS: The cost of the agreement with Brown and Caldwell to provide engineering design services for the amendment will not exceed $218,098. Funds are available from the Sewer User Fund and have been appropriated to Project No. 23-130 (WW2401 Digester Cover Replacement). BOARD/COMMISSION RECOMMENDATION: Not applicable STAKEHOLDER PROCESS: None ALTERNATIVES: The no-action alternative will eliminate the opportunity design Phase 5.1 to ensure the systems installed as part of the Digester project will work with the controllers. The older systems will have to be upgraded in the future or may not work with the new mixer system and will have to be upgraded later at a higher cost to the city RECOMMENDATION: Approval of the Resolution. ATTACHMENTS: 1. 9-22-25 23-130 Amend 1 Digester Polymer Electrical RESOLUTION NO.16121 A RESOLUTION APPROVING AND AUTHORIZING THE PURCHASING AGENT TO EXECUTE AMENDMENT NO. 1 TO THE AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND BROWN AND CALDWELL, INC., IN THE AMOUNT OF $218,098 FOR PROJECT NO. 23-130, WASTEWATER DEPARTMENT ENGINEER OF RECORD DIGESTER COVERS AND MIXING SYSTEM REPLACEMENT, POLYMER SYSTEM REPLACEMENT AND PHASE 4 ELECTRICAL IMPROVEMENTS PROJECT WHEREAS, Project No. 23-130 Wastewater Department Engineer of Record Digester Covers and Mixing System Replacement, Polymer System Replacement and Phase 4 Electrical Improvements Project was awarded to Brown and Caldwell, Inc., on September 10, 2024 and WHEREAS, additional design and engineering work contemplated by Amendment No. 1 is needed; and WHEREAS, it is in the best interest of the City to proceed with and complete such design in the manner herein provided; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. The Amendment No. 1, by and between the City of Pueblo, a Colorado Municipal Corporation, and Brown and Caldwell, Inc., a California Corporation, a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved, and City Council authorizes the additional work contemplated by Amendment No. 1 to be performed in the amount of $218,098. SECTION 2. Funds in the amount of $218,098 will be paid from WW2401 Digester Cover Replacement, SECTION 3. The Purchasing Agent is hereby authorized to execute Amendment No. 1 on behalf of the City of Pueblo, a Colorado Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the same. SECTION 4. The officers of the City are authorized to perform any and all acts consistent with this Resolution to implement the policies and procedures described herein.
