HomeMy WebLinkAbout11025 City Clerk's Office Item # S5 Background Paper for Proposed Ordinance COUNCIL MEETING DATE: August 25, 2025 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Greg Pedroza, Director Aviation SUBJECT: AN ORDINANCE APPROVING AN OCCUPANCY AGREEMENT BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND SAAB, INC., A FOREIGN BUSINESS CORPORATION, AND AUTHORIZING THE MAYOR TO EXECUTE SAME SUMMARY: This Ordinance will approve an Occupancy Agreement between the City of Pueblo, a Colorado Municipal Corporation, and Saab, Inc., a Foreign Business Corporation to allow Saab the use of the Premises for the purpose installing data gathering equipment that will provide the FAA Air Traffic Control Tower with essential information that could potentially avoid incursions and provide for a safer airport PREVIOUS COUNCIL ACTION: None. BACKGROUND: Saab, Inc. has been contracted by the FAA to install data gathering equipment that will provide the FAA Air Traffic Control Tower with essential information that could potentially avoid incursions and provide for a safer airport. Whereas the equipment will be used by the FAA, the installation sites for the equipment will be on Airport property owned by the City of Pueblo. FINANCIAL IMPLICATIONS: As the Airport Operator, the City of Pueblo is responsible for providing some navigational aids to offer a safe airport operating environment. The equipment will be installed at existing City-owned navigational aid sites and require electricity provided by the City at an estimated cost of $150 per year. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Resolution. STAKEHOLDER PROCESS: Not applicable to this Resolution. ALTERNATIVES: If this Ordinance is not approved, then Saab will not be allowed to install equipment to benefit the FAA. RECOMMENDATION: Approval of the Resolution. ATTACHMENTS: 1. PLACEHOLDER Saab 2025 08 25 DRAFT AGREEMENT ORDINANCE NO.11025 AN ORDINANCE APPROVING AN OCCUPANCY AGREEMENT BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND SAAB, INC., A FOREIGN BUSINESS CORPORATION, AND AUTHORIZING THE MAYOR TO EXECUTE SAME WHEREAS, the City of Pueblo is the owner and operator of the Pueblo Memorial Airport together with the land on which said Airport is situated; and WHEREAS, Saab Inc is desirous of occupying certain property for the purpose of installing data gathering equipment that will provide the United States Federal Aviation Administration Air Traffic Control Tower with essential information that could potentially avoid incursions and provide for a safer airport, where said property is owned by the City of Pueblo; now therefore, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Pueblo, a Colorado Municipal Corporation, and Saab, Inc., a Foreign Business Corporation, to occupying certain property for the purpose of installing data gathering equipment at the Pueblo Memorial Airport, a copy of which is attached hereto and made a part hereof by reference, after having been approved as to form by the City Attorney, is hereby approved SECTION 2. The Mayor is hereby authorized to execute the Lease on behalf of the City of Pueblo, and the City Clerk shall affix the Seal of the City thereto and attest same. SECTION 3. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of this Ordinance and the attached Lease to effectuate the terms and conditions described therein. SECTION 4. This Ordinance shall become effective on the date of final action by the Mayor and City Council.
