HomeMy WebLinkAbout16102RESOLUTION NO.16102 A RESOLUTION TO INITIATE BY APPLICATION TO THE HISTORIC PRESERVATION COMMISSION THE DESIGNATION OF 330 SOUTH CITY PARK AVENUE, CITY PARK BATH HOUSE, AS A LOCAL HISTORIC LANDMARK WHEREAS, on September 9, 2024, City Council passed Ordinance 10778 designating 330 South WHEREAS, on September 10, 2024, the Mayor disapproved Ordinance 1078, by way of veto; and WHEREAS, City Council believes that the City Park Bath House meets the requirements to be designated as a Local Historic Landmark pursuant to Sec. 4-14-8, P.M.C., and should therefore be designated as such; and WHEREAS, pursuant to the City of Pueblo's Historic Preservation Code, Chapter 14, Title IV, the designation of a Local Historic Landmark may be initiated by City Council filing an application for designation with the Historic Preservation Commission for review and recommendation, including all data required by HPC and payment of such fee as may be required from Council Contingencies; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. City Council requests the Mayor to direct staff, or in the alternative authorizes the President of City Council, to present an application to the Historic Preservation Commission to take all steps necessary to allow City Council to be presented with an ordinance of local historic landmark designation. SECTION 2. Payment in the amount of $150.00 from the Council Contingencies Account in the 2025 General Fund Budget is authorized to be paid to the Historic Preservation Commission for Nomination of Historic Landmark processing fee. SECTION 3. The officers and staff of the City are authorized and directed to perform any and all acts consistent with the intent of this resolution to effectuate the policies and procedures described herein. SECTION 4. This resolution shall become effective immediately upon final passage. Council did not act to override BACKGROUND: is resolution stems from direction by City Councilman Dennis Flores to pursue the aforementioned local historic landmark designation. The City of Pueblo's Historic Preservation Code, Chapter 14, Title IV, provides the designation of a Landmark may be initiated by application of City Council filed with the Historic Preservation Commission HPC and payment of such fee as established. While historic designations are made by the passage of an ordinance by Council, all designations begin with the submittal of an application to the Historic Preservation Commission. This process allows for the involvement of stakeholders, members of the community and City staff to deliberate and offer input prior to City Council considering any ordinance designating a historic landmark FINANCIAL IMPLICATIONS: Pursuant to the Pueblo Municipal Code, the City, as owner of the City Park Bath House, shall be responsible for the costs associated with maintaining the City Park Bath House to meet requirements of Title IV and Chapter 1 of Title VIII BOARD/COMMISSION RECOMMENDATION: Not applicable. STAKEHOLDER PROCESS: The stakeholder process will take place during commission hearings. ALTERNATIVES: City Council could choose to vote no and maintain the status quo lack of designation. RECOMMENDATION: This resolution is at the request of Councilman Dennis Flores. ATTACHMENTS: None
