HomeMy WebLinkAbout16099RESOLUTION NO.16099 A RESOLUTION ADOPTING AND APPROVING THE CITY OF PUEBLO PUBLIC RIGHT-OF-WAY AMERICANS WITH DISABILITIES ACT (ADA) TRANSITION PLAN FOR THE CITY OF PUEBLO WHEREAS, the Americans with Disabilities Act of 1990 (ADA) was signed into Law on July 26, 1990; and WHEREAS, the enclosed City of Pueblo Public Right-of-Way ADA Transition Plan, which designates the ADA coordinator, public grievance procedure, self-evaluation, potential barriers to access, prioritization of barrier removal, barrier removal funding, public engagement & feedback, implementation timeline, monitoring & update, relevant external links, summary of ADA ramp inventory and the English & Spanish versions of ADA compliant forms; NOW, THEREFORE; BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. The City of Pueblo hereby adopts and approves the attached City of Pueblo Public Right- of-Way ADA Transition Plan. SECTION 2. Charles "Chuck" Roy, P.E., Acting Director of Public Works Department is hereby designated as the responsible employee under 28 CFR 35.107 to coordinate the efforts of the City of Pueblo to comply with and carry out its responsibilities under the Americans with Disabilities Act of 1990, and the regulations promulgated thereunder, including any investigation of any complaint communicated to it alleging its noncompliance therewith or alleging any actions that would be prohibited thereby. Charles "Chuck" Roy, P.E., Acting Director of Public Works Department may designate one or more individuals as the responsible employee(s) under 28 CFR 35.107 and delegate to such person(s) the authority to perform some or all of the functions therein required. SECTION 3. Charles "Chuck" Roy, P.E., Acting Director of Public Works Department is hereby authorized and directed to execute any federally required certifications that the City of Pueblo has adopted the enclosed City of Pueblo Public Right-of-Way ADA Transition Plan. SECTION 4. This Resolution and the City of Pueblo Public Right-of-Way ADA Transition Plan are hereby approved and adopted and amend and supersede the provisions of the prior Americans with Disabilities Act (ADA) Transition Plan for the City of Pueblo, adopted by Resolution number 6975, which relate to sidewalk and curb ramps and elimination of barriers to pedestrian accessibility in public rights-of-way for which the City of Pueblo has operation and maintenance responsibilities. SECTION 5. The officers of the City are authorized to perform any and all acts consistent with the intent of the Resolution to implement the policies and procedures described herein. SECTION 6. This Resolution shall become effective immediately upon final approval. PREVIOUS COUNCIL ACTION: City Council adopted and approved the current ADA Transition Plan by Resolution 6975, dated July 27, 1992. BACKGROUND: The City of Pueblo (the City) is committed to ensuring accessibility for all residents and visitors, in accordance with the Americans with Disabilities Act (ADA), as amended, and Section 504 of the Rehabilitation Act (Section 504). This Transition Plan outlines the City's strategy to identify and remove barriers and ensure compliance with federal and state accessibility standards. -term strategic approach to continue improvements to the accessibility of City facilities, programs, activities, and services. This Transition Plan is a living document subject to frequent changes and updates as new work is completed, regulations change, and engineering and technology enhancements are developed. FINANCIAL IMPLICATIONS: Each year, the City upgrades or repairs numerous curb ramps and sidewalks in conjunction with road repair and pavement maintenance projects taking place across the City. Although the cost will vary depending on site conditions, the typical cost to install a curb ramp is approximately $10,000.00 to $12,000.00. The Public Works Department also applies annually for grants to supplement resources available to maximize the number of curb ramps being brought into compliance with current accessibility standards, thereby increasing mobility and accessibility for people with disabilities within the city. BOARD/COMMISSION RECOMMENDATION: The ADA Advisory Committee reviewed and provided comment on the proposed City of Pueblo Public Right-of-Way ADA Transition Plan. STAKEHOLDER PROCESS: The City of Pueblo Public Works Department and the ADA Coordinator meet monthly with the ADA Advisory Committee who provides insight and review of City facilities for ADA compliance. ALTERNATIVES: The existing ADA Transition Plan, adopted in 1992, will remain in effect if the Resolution is not approved. RECOMMENDATION: Approval of the Resolution. ATTACHMENTS: 1.
