HomeMy WebLinkAbout11021 City Clerk's Office Item # S1 Background Paper for Proposed Ordinance COUNCIL MEETING DATE: August 11, 2025 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Beritt Odom, Director of Planning SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS TO REZONE 711 AND 715 VETA AVENUE, LOTS 11-14, BLOCK 7, ARVONIA SUBDIVISION, FROM R-3, ONE AND TWO-FAMILY RESIDENTIAL ZONE DISTRICT TO RCN, RESIDENTIAL CHARTER NEIGHBORHOOD ZONE DISTRICT SUMMARY: The applicant is requesting to rezone 711 and 715 Veta Avenue, Lots 11-14, Block 7, Arvonia Subdivision, from R-3 to an RCN Zone District to facilitate a rearrangement of property boundaries that will rearrange four 25-foot-wide lots into two parcels that meet the lot width requirement for the RCN Zone District. PREVIOUS COUNCIL ACTION: The applicant is concurrently requesting a rearrangement of property boundaries (RPB- 25-07). BACKGROUND: The applicant is requesting to rezone 711 and 715 Veta Avenue to an RCN Zone District to facilitate a Rearrangement of Property Boundaries (RPB), which is intended to rearrange four 25-foot-wide lots into two parcels that meet the minimum lot width requirements for the RCN Zone District. The RPB will be processed administratively and is contingent upon final approval of this rezoning by City Council. The proposed RPB will incorporate the existing one car garage, with the residence located at 711 Veta Avenue. The existing garage, which currently sits on the 715 Veta Avenue parcel, has the same white horizontal siding and dark gray asphalt roofing materials as the residence located at 711 Veta Avenue. Therefore, the proposed rezoning and RPB will further the intent of both the Accessory Building and Residential Placement Standards sections of the municipal code by combining the single-family residence on 711 Veta with the architecturally compatible garage located at 715 Veta. The RCN Zone District requires a mi-family residence. The proposed RPB will create one 32-foot-wide lot and another 68-foot-wide lot, so both lots meet the minimum area and width requirements for the RCN Zone District. According to the submitted site plan, 715 Veta has an existing northern side- yard setback of 2.5 feet and a front-yard setback of 25-feet. The northern 2.5-foot side yard setback for 715 Veta is considered a legal-nonconforming setback and can remain as-is with the RPB. The proposed RPB would create a new side yard to the south for 715 Veta, which would be 5 feet and conform with current setback requirements. 711 Veta has an existing 20-foot front-yard setback and a 6.8-foot southern side-yard setback. The proposed RPB would create a 5.6- foot northern side-yard setback for 711 Veta. The existing front-yard setback may be averaged with the adjacent house to the south, thus meeting the code requirements for front yard setbacks. The purpose of the RCN district is to creatively accommodate redevelopment on narrow, legal non- conforming lots in the older neighborhoods of the City, and this project meets that intent. The proposed rezoning and RPB will not create any new non-conforming setbacks or lot dimensions. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their July 9, 2025, Regular Meeting, voted 7- 0 to recommend approval. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance the property will not be zoned in accordance with the Pueblo Municipal Code. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance. The zoning restrictions covering the following described property, and in addition half of all adjacent dedicated roadway and alley rights-of-way, together generally identified in the attached Rezone Exhibit, is hereby changed from R-3, One and Two-Family Residential Zone District to RCN, Residential Charter Neighborhood Zone District: Lots 11-14, Block 7, Arvonia Subdivision SECTION 2. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of the Ordinance to implement the policies and procedures described herein. SECTION 3. This Ordinance shall become effective immediately upon final action by the Mayor and City Council.
