HomeMy WebLinkAbout16086 City Clerk's Office Item # M12 Background Paper for Proposed Resolution COUNCIL MEETING DATE: August 11, 2025 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Andrew Hayes, Public Works Director SUBJECT: A RESOLUTION DIRECTING THE PUEBLO URBAN RENEWAL AUTHORITY TO ENTER INTO DEVELOPMENT AGREEMENTS TO PROVIDE INCENTIVES TO OFFSET A PORTION OF THE COST OF STATE HIGHWAY IMPROVEMENTS REQUIRED BY THE COLORADO DEPARTMENT OF TRANSPORTATION ON PUEBLO BOULEVARD GENERALLY BETWEEN I-25 AND PRAIRIE AVENUE WITHIN THE LAKE MINNEQUA URBAN RENEWAL PROJECT AREA SUMMARY: This Resolution directs the Pueblo Urban Renewal Authority (PURA) to draft and negotiate development agreements with property owners adjacent to Pueblo Boulevard to offset a share of the total cost of improvements within the state highway right-of-way required by the Colorado Department of Transportation as a condition of development. PREVIOUS COUNCIL ACTION: Ordinance No. 7630 was passed by City Council on August 13, 2007, approving the Lake Minnequa Urban Renewal Project Plan which authorizes PURA to undertake certain projects within the plan area and to provide funding for those projects. BACKGROUND: Multiple landowners along the Pueblo Boulevard corridor generally between I-25 and Prairie Avenue are actively developing or have applied for building permits to develop their properties. The Colorado Department of Transportation, as a condition of development, has required that certain transportation-related improvements including a traffic signal, raised median, acceleration/deceleration lanes, striping, signage, and other associated work be installed in order to safely accommodate the additional traffic generated by these ongoing and proposed development projects. There are a number of undeveloped properties along the corridor that will also directly benefit from the installation of these improvements, but the cost to any single property owner to complete all of the required improvements along this corridor are far too high for any one property owner to absorb alone. The equitable allocation of these costs across all benefited property owners and the public at large is not supported through CDOT's access permitting process, and the developers have requested the City's assistance to utilize the resources dedicated for these purposes to offset at least a portion of the installation cost for these improvements. This proposed development incentive framework is supported by the existing and approved Lake Minnequa Urban Renewal Project Plan, which authorizes PURA to enter into development agreements with these property owners and to reduce the financial burden of installing these improvements to a reasonable amount, proportional to the impacts generated by each respective project. This Resolution expresses Council's support for PURA to engage with affected property owners to facilitate development of the properties along the Pueblo Boulevard corridor while simultaneously ensuring safe and efficient highway operations can continue with additional traffic demands in the area. FINANCIAL IMPLICATIONS: There are no direct financial implications to the City as a result of approval of this Resolution. City Council has already approved the use of tax increment funds within this district for improvement projects authorized under the Lake Minnequa Urban Renewal Project Plan. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Resolution. STAKEHOLDER PROCESS: Not applicable to this Resolution. ALTERNATIVES: Failure to approve this Resolution will signal Council's intent that it does not support the establishment of a new urban renewal district in the area at this time. RECOMMENDATION: Approval of the Resolution. ATTACHMENTS: None RESOLUTION NO.16086 A RESOLUTION DIRECTING THE PUEBLO URBAN RENEWAL AUTHORITY TO ENTER INTO DEVELOPMENT AGREEMENTS TO PROVIDE INCENTIVES TO OFFSET A PORTION OF THE COST OF STATE HIGHWAY IMPROVEMENTS REQUIRED BY THE COLORADO DEPARTMENT OF TRANSPORTATION ON PUEBLO BOULEVARD GENERALLY BETWEEN I-25 AND PRAIRIE AVENUE WITHIN THE LAKE MINNEQUA URBAN RENEWAL PROJECT AREA WHEREAS, the City of Pueblo has received applications for the development of several properties along W. Pueblo Boulevard, a state highway designated as Colorado State Highway 45 within the City of Pueblo; and WHEREAS, the Colorado Department of Transportation ("CDOT"), through their authority to control access to and from state highways, is requiring the installation of certain public highway improvements as a condition of development; and WHEREAS, the property owners of the properties obligated to install the CDOT required improvements have requested City assistance to facilitate the equitable distribution of the cost burden to install the required public improvements across all benefitted properties; and WHEREAS, City Council previously approved the Lake Minnequa Urban Renewal Project Plan (the "Plan") which authorizes the Pueblo Urban Renewal Authority ("PURA") to utilize tax increment funding to undertake certain public improvement projects within the Plan area, including roadway improvements along W. Pueblo Boulevard in accordance with Colorado Urban Renewal Law. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. Pueblo Urban Renewal Authority ("PURA") is hereby directed to enter into development agreements with the owners of properties obligated to install CDOT-required public improvements within the Lake Minnequa Urban Renewal Project Plan Area that benefit multiple property owners or the public at large. SECTION 2. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of this Resolution to effectuate the policies and procedures described herein. SECTION 3. This Resolution shall become effective upon passage and approval.
