HomeMy WebLinkAbout11006 City Clerk's Office Item # S1 Background Paper for Proposed Ordinance COUNCIL MEETING DATE: July 28, 2025 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Scott Hobson, Acting Director Planning and Community Development SUBJECT: AN ORDINANCE AMENDING SECTION 17-4-44 (H) OF CHAPTER 4 OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO MINIMUM DISTANCE BETWEEN DRIVEWAY ACCESSES AND INTERSECTIONS SUMMARY: Attached for consideration is a text amendment that will update Chapter 4 of Title XVII of the Pueblo Municipal Code relating to driveway accesses from intersections. PREVIOUS COUNCIL ACTION: Ordinance 5015, dated November 22, 1982, created Section 17-4-42, 17-4-43, 17-4-44 and 17-4-45, creating the current parking standards. Ordinance 9190, dated October 10, 2017, amended several subsections of Sec. 17-4- 44, including (h). The amendment to Subsection (h) required paving the alley from the point of access to the nearest roadway and may also require improvements to the alley apron at the intersecting roadway as determined by the Director of Public Works. BACKGROUND: This is an administrative change to ensure City Code reflects current City Engineering and traffic standards. This revision is to Sec. 17-4-44 (h) to reflect 40-feet setback from intersections in lieu of the previous 35-feet. This is a legacy item that has been enforced since the revision of the City of Pueblo Standard Construction Specifications and Standard Details on March 28, 2005. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their June 11, 2025 Regular Meeting, voted 7-0 to recommend approval. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing by publication of the proposed amendment fifteen (15) days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance, Title XVII of the Pueblo Municipal Code will not be amended to reflect current City Engineering and traffic standards. RECOMMENDATION: Approve the proposed Ordinance. ATTACHMENTS: 1. Subsection (h) of Section 17-4-44. - Off-street parking general requirements are amended to read as follows: Sec. 17-4-44. - Off-street parking general requirements. (h) Access-Minimum. Unobstructed and direct accessways (driveways) shall be provided to the parking area from a public street or alley. Driveways shall be approximately perpendicular to the street or alley and shall be located no closer than \[thirty-five (35)\] forty (40) feet from the nearest intersection except in severe hardship instances, subject to approval by the City \[Traffic\] Engineer. All curb cuts for driveways shall be approved by the City \[Traffic\] Engineer. Alley access must provide paving from the point of access to the nearest roadway and may also require improvements to the alley apron at the intersecting roadway as determined by the Director of Public Works. SECTION 2. The officers and staff of the City are authorized to perform any and all acts consistent with this Ordinance to implement the policies and procedures described herein. SECTION 3. This Ordinance shall become effective immediately after the date of final action by the Mayor and City Council. Motion Passed: 7-0 TEXT AMENDMENT TA-25-01 TO: City of Pueblo Planning and Zoning Commission FROM: Hannah Prinzi, Planner THROUGH: Scott Hobson, Acting Director of Planning and Community Development DATE: June 11th, 2025 SUBJECT: AN ORDINANCE AMENDING SECTION 17-4-4., (h) OF CHAPTER 4 OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO MINIMUM DISTANCE BETWEEN DRIVEWAY ACCESSES AND INTERESECTIONS BACKGROUND AND ANALYSIS: The purpose of this Text Amendment is to ensure consistency between City Engineering and Traffic standards and the City code. Currently, Section 17-4-44. (h) of the Pueblo Municipal Code sets a 35-foot minimum distance required between driveway accesses and the nearest intersection. However, the City of Pueblo Standard Construction Specifications and Standard Details outline a 40-foot minimum. City Engineering and Traffic staff have been adhering to the 40-foot minimum when reviewing projects. The Text Amendment would ensure the City code reflects current City Engineering and Traffic standards and practice that have been in place for a number of years. RECOMMENDATION: If the Planning and Zoning Commission finds the proposed Text Amendment regarding the required distance from intersections is appropriate, staff recommends a recommendation of APPROVAL of the Text Amendment to be forwarded to City Council.
