HomeMy WebLinkAbout10989* City Clerk's Office Item # R6 Background Paper for Proposed Ordinance COUNCIL MEETING DATE: July 14, 2025 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Carla Sikes, City Attorney SUBJECT: AN ORDINANCE APPROVING AN AMENDED AND RESTATED INTERGOVERNMENTAL AGREEMENT BY AND BETWEEN THE CITY OF PUEBLO, PUEBLO COUNTY, AND THE PUEBLO CITY-COUNTY LIBRARY DISTRICT FOR THE SELECTION OF TRUSTEES TO THE PUEBLO CITY-COUNTY LIBRARY DISTRICT BOARD SUMMARY: Attached is an Ordinance approving an Intergovernmental Agreement by and between the City of Pueblo, Pueblo County, and the Pueblo City-County Library District pursuant to C.R.S. §24-90-107(2). PREVIOUS COUNCIL ACTION: On January 27, 1969, by Ordinance No. 3240, City Council established the Pueblo Regional District Library and approved an intergovernmental agreement for the operation of the same. On January 23, 1978, by Resolution No. 4123, City Council recognized and ratified the joint creation of the Pueblo Regional Library District by the City of Pueblo and Pueblo County nunc pro tunc January 1, 1969 by joint Resolution dated July 15, 1968. BACKGROUND: The Pueblo City- and Pueblo County on or about July 15, 1968. Originally, the City and County provided all buildings, equipment, and library materials for PPCLD and funded its operation. Through mill levies, PPCLD generated sufficient income to become self- sustaining. Over time, the City transferred ownership of all real and personal property used to provide library services to PCCLD. PCCLD operates pursuant to Colorado statute, C.R.S. §24-90-101 et seq. While the City no longer financially subsidizes Board of Trustees. The City and County make up the selection committee that nominates members of the public to vacant seats on the Board of Trustees. Pursuant to statute, the appointees to the library board of trustees are appointed by the mayor with the consent of the legislative body. See C.R.S. §24-90-108(2)(a). The attached intergovernmental agreement sets forth the process by which Trustees have been, and will continue to be nominated, appointed and removed. FINANCIAL IMPLICATIONS: None. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: If this Ordinance is not approved, the City and County will continue the current process. RECOMMENDATION: Approve the Ordinance. ATTACHMENTS: 1. ORDINANCE NO.10989 AN ORDINANCE APPROVING AN AMENDED AND RESTATED INTERGOVERNMENTAL AGREEMENT BY AND BETWEEN THE CITY OF PUEBLO, PUEBLO COUNTY, AND THE PUEBLO CITY- COUNTY LIBRARY DISTRICT FOR THE SELECTION OF TRUSTEES TO THE PUEBLO CITY-COUNTY LIBRARY DISTRICT BOARD BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Amended and Restated Intergovernmental Agreement by and between the City of Pueblo, Pueblo County, and the Pueblo City-County Library District, a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved. The Mayor is authorized to execute and deliver the intergovernmental agreement in the name of the City and the Acting City Clerk is directed to affix the seal of the City thereto and attest same. SECTION 2. The officers and staff of the City are authorized and directed to perform any and all acts consistent with this Ordinance and the attached Lease which are necessary or desirable to effectuate the transactions described therein. SECTION 3. This Ordinance shall become effective on the date of final action by the Mayor and City Council.
