AMERICAN RESCUE PLAN ACT INFORMATION TECHNOLOGY
RAILROAD PERMITS TO THE INSTALLATION OF FIBER-OPTIC
CABLE NETWORK INFRASTRUCTURE FOR THE VIDEO
SURVEILLANCE EQUIPMENT IN THE PARKS, AS AUTHORIZED BY
SECTION 603 (A) OF THE AMERICAN RESCUE PLAN ACT AND U.S.
TREASURY FINAL RULE 31 CFR 35
SUMMARY:
This
the installation of the fiber-optic network infrastructure for the connection of all
components related to video surveillance and applicable wireless in the Parks.
PREVIOUS COUNCIL ACTION:
By Ordinance No. 9931, approved on May 17, 2021, the City Council established
Project No. CI2113 and budgeted and appropriated up to $36.7 million in funds which
were expected to be distributed to the City from the American Recovery Plan Act
which began on March 3, 2021, until December 31, 2024, (to be expended by
December 31, 2026).
By Resolution 15704, approved on August 12, 2024, for railroad permitting complete
the installation of fiber-optic cable network infrastructure for the new fire stations and
wastewater treatment facility.
By Resolution 15850, approved on December 9, 2024, for video surveillance
improvements in Parks.
BACKGROUND:
Funding for railroad permitting was approved by Resolution 15704 on August 12, 2024,
for a secondary fiber route for the new Fire Station 11 and the new County jail. During
design, several construction issues were encountered related to a section of fiber
required from the new jail to Thatcher Blvd. Several alternative routes and options
were explored to solve the issues, and unfortunately, the only workable solution
increased costs beyond the available budget. Consequently, this section of the fiber
project was abandoned, eliminating the need for additional railroad permits.
The video surveillance in the Parks project, approved by Resolution 15850 on
December 9, 2024, requires additional funding to complete fiber-optic network
infrastructure for surveillance equipment. Reallocating the railroad permitting funds to
the video surveillance project will cover the increased costs of the fiber-optic cable
installation for this equipment.
The costs associated with broadband infrastructure related to the protection of mission-
critical public safety applications is an eligible use of ARPA funds 31C.F.R.
35.6(b)(3)(ii)(E)(4).
FINANCIAL IMPLICATIONS:
This reallocation of funds within Project CI2113 adds no additional expense to funds
already budgeted. The funds being reallocated were those budgeted due to interest
earned on ARPA proceeds and are not subject to program restrictions.

ALTERNATIVES:
The City Council could decide not to support the reallocation of funding, preventing
video surveillance equipment from being installed in several areas of the different
parks, compromising video coverage.

WHEREAS, on March 11, 2021, President Biden signed the U.S. Senate-amended
H.R.1319 (P.L. 117-
WHEREAS, on May 10, 2021, the U.S. Treasury issued the Interim Final Rule to
WHEREAS, by Ordinance No. 9931, approved on May 17, 2021, the City Council
established Project No. CI-2113 and budgeted and appropriated up to $36.7 million in funds
which were expected to be distributed to the City from ARPA for covered costs and eligible
expenses to be incurred during the period which began on March 3, 2021, until December 31,
2024 (to be expended by December 31, 2026); and
WHEREAS, on January 6, 2022, the U.S. Treasury issued, with an effective date of April 1,
2022, the Final Rule to implement ARPA in Title 31, Part 35 of the CFR; and
WHEREAS, under the Final Rule, recipients may use Coronavirus State and Local Fiscal
-19 public health emergency and the
negative economic consequences resulting therefrom; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that
SECTION 1.
Funds in the amount of two hundred and twenty-seven thousand, nine hundred and fifty-
six dollars ($227,956) are hereby reallocated from Information Technology Railroad Permits and
authorized for payment from Project No. CI2113 American Rescue Plan Act, for purposes of
implementing fiber-optic network infrastructure required to complete the fiber-optic cable
infrastructure for video surveillance in the parks.
SECTION 2.
The officers and staff of the City are authorized to perform all acts consistent with this
Resolution to implement the policies and procedures described herein.
SECTION 3.
This Resolution shall become effective immediately upon final passage.
