HomeMy WebLinkAbout10967 City Clerk's Office Item # S1 Background Paper for Proposed Ordinance COUNCIL MEETING DATE: June 9, 2025 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Noah Stamm, Civil Engineer Drainage SUBJECT: AN EMERGENCY ORDINANCE TRANSFERRING $2,000,000 FROM THE UNAPPROPRIATED FUND BALANCE OF THE STORMWATER UTILITY ENTERPRISE TO PROJECT SWAN03 - POINT REPAIRS AND PIPE CLEANING, BUDGETING AND APPROPRIATING FUNDS IN THE AMOUNT OF $2,000,000 FOR SAID PROJECT AND AUTHORIZING THE MAYOR TO EXECUTE THE SAME SUMMARY: This Emergency Ordinance transfers funds in the amount of $2,000,000 from the unappropriated fund balance of the Stormwater Utility Enterprise to Project SWAN03 - Point Repairs and Pipe Cleaning, and budgets and appropriates funds totaling $2,000,000 for said Project. PREVIOUS COUNCIL ACTION: None. BACKGROUND: Following recent heavy rainfall, two sinkholes have developed in public right-of-way. The th first sinkhole is located at the intersection of W 12 Street and Elizabeth Street. Street repairs at this location were previously identified, budgeted, and appropriated; however, the recent heavy rainfall undermined the repairs and created unstable trench conditions necessitating an expanded scope of work, which now requires reconstruction of the entire road. This project currently contains insufficient funds to pay the additional cost of the expanded work resulting from the unprecedented weather conditions. The second sinkhole is located on Union Avenue. It also creates a significant risk to the health and safety of the public. The Stormwater Utility is unable to complete repairs to this sinkhole at this time due to insufficient available funds for the project. The Stormwater Utility Enterprise has all but exhausted the funds previously appropriated for storm sewer emergency point repair projects. This additional funding is necessary to repair the two sinkholes that resulted from the recent heavy rainfall, as well as to respond to storm sewer emergency point repairs for the remainder of 2025. The continued ability of storm water to perform emergency repairs is imperative to protect the general health and welfare of the public. FINANCIAL IMPLICATIONS: Funds in the amount of $2,000,000 will be transferred from the unappropriated fund balance of the Stormwater Utility Enterprise fund to SWAN03 - Point Repairs and Pipe Cleaning. BOARD/COMMISSION RECOMMENDATION: None. STAKEHOLDER PROCESS: None. ALTERNATIVES: Council could elect not to allow the transfer of funds, and the Stormwater Utility Enterprise would not have the funds to execute future storm sewer emergency point repair projects. RECOMMENDATION: Approval of the Emergency Ordinance ATTACHMENTS: None ORDINANCE NO. 10967 AN EMERGENCY ORDINANCE TRANSFERRING $2,000,000 FROM THE UNAPPROPRIATED FUND BALANCE OF THE STORMWATER UTILITY ENTERPRISE TO PROJECT SWAN03 - POINT REPAIRS AND PIPE CLEANING, BUDGETING AND APPROPRIATING FUNDS IN THE AMOUNT OF $2,000,000 FOR SAID PROJECT AND AUTHORIZING THE MAYOR TO EXECUTE THE SAME WHEREAS, recent heavy rainfall has created two sinkholes in the public right-of-way and these sinkholes create a significant risk to the health, safety, and welfare of the public; and WHEREAS, the Stormwater Utility lacks sufficient funds to perform these necessary emergency point repairs and any others that may arise during the remainder of 2025; and WHEREAS, the Emergency Ordinance is necessary to transfer funds to complete necessary point repairs to City infrastructure; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Funds in the amount of $2,000,000 are hereby transferred from the unappropriated fund balance of the Stormwater Utility Enterprise fund into Project SWAN03 - Point Repairs and Pipe Cleaning, and budgeted and appropriated for said Project. SECTION 2. The City Council finds that this Ordinance qualifies for treatment as an Emergency Ordinance pursuant to City Charter as is necessary for the preservation of public health, property, or safety. Pursuant to Sec. 3-20 of the City Charter, this Ordinance shall become effective upon final action by the Mayor and City Council. SECTION 3. The officers and staff of the City are authorized to perform any and all acts consistent with this Emergency Ordinance to implement the policies and procedures described herein.
