SUMMARY:
The applicant is requesting to rezone 0.14-acres at 2403 Thatcher Avenue, generally
located east of The Sunset Inn, from B-1, Neighborhood Business Zone District to B-3,
Highway and Arterial Business Zone District to permit an auto repair shop.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
The property owner is requesting to rezone 0.14-acres at 2403 Thatcher Avenue from
Neighborhood Business (B-1) to Highway and Arterial (B-3) Zone District to permit an
auto repair shop. The subject property is located at the northwest corner of Thatcher
Avenue and Acero Avenue and is developed with an automotive repair structure that
includes two automobile repair bays with garage doors and an office. The commercial
structure was built in 1980 and has operated as an auto repair shop since its
construction. An application for a business license at this property was submitted August
2024. At that time, they were notified that an auto repair shop cannot be permitted in a
B-1 Zone District. The property owner then submitted a rezoning application January
2025.
Prior to 2015, a service station was allowed in a Neighborhood Business (B-1) Zone
District. A service station meant a building and premise where automobile parts and
services were available for retail. Services included replacing mufflers and tail pipes,
repairing brakes, minor repair of carburetors, and more. The code was updated in 2015,
which is when the service station use definition was removed and replaced with four
different use definitions for an automobile repair. The definitions were split to differentiate
the use based on the intensity of the goods and services provided by the automobile
repair. Only the lowest intensity auto repair shops a lube shop and paintless dent repair
shop are now allowed in a B-1 Zone District (See Exhibit G. Table of Uses). When this
change occurred, the subject property could continue operating as a legal non-
conforming use; however, the use ceased for more than thirty days (Sec. 17-3-3., (3)).
Thus, the subject property lost its legal non-conforming status and must comply with
code.
As mentioned, the subject property is currently zoned Neighborhood Business (B-1). This
district is designed to provide goods and services to the immediate neighborhood without
creating any nuisance to nearby homes. In adhering to this purpose, only auto repair
shops that provide minor services may operate in a B-1. The proposed business at the
subject property provides more intense services and therefore could not be permitted in
a B-1 Zone District.
Should the subject property be rezoned to Highway and Arterial Business (B-3) Zone
District, the applicant could obtain a business license for the proposed business. The B-
3 Zone District is intended to provide areas along highways and arterial streets for
location of business and services. Thatcher Avenue is classified as a major arterial road,
providing continuous traffic movement to connect neighborhoods, areas, and regional
features at higher speeds with limited access. A B-3 Zone District located adjacent to
Thatcher Ave is in line with the intent of the Zone District. The subject property also
meets district standards for minimum lot width and size for a B-3 Zone District.
The rezoning to a B-3 District would allow a business license for
general repair, rebuilding or reconditioning of engines, transmissions,
differentials, drivetrains, or any parts thereof. This use includes muffler shops, auto repair
garages, tire repair and installation, wheel and brake shops, and similar repair and
ser-2-2.,

The 2022 Regional Comprehensive Plan designates this area as Neighborhood Mixed
Use. These areas are intended to accommodate small-scale commercial activity and
neighborhood-supportive services in historic hubs of the City. Rezoning to B-3 would fit
the intent of the Comp Plan by providing auto repair services to the surrounding
neighborhood.
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their April 9, 2025, Regular Meeting, voted 7-
0 to recommend approval.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission Public
Hearing to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public
Hearing.
ALTERNATIVES:
If City Council does not approve this Ordinance the property will not be zoned in
accordance with the Pueblo Municipal Code.
Upon request of City Council, the Ordinance could be returned to the Planning and
Zoning Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Ordinance.

BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property, and in addition half of
all adjacent dedicated roadway and alley rights-of-way, together generally identified in the
attached Rezone Exhibit, is hereby changed from B-1, Neighborhood Business Zone District to
B-3, Highway and Arterial Business Zone District:

SECTION 2.
The officers and staff of the City are authorized to perform any and all acts consistent with
the intent of the Ordinance to implement the policies and procedures described herein.

and size for a B-3 Zone District.
To be clear, the rezoning would allow a business license for
“a facility for the general repair, rebuilding or reconditioning of engines, transmissions, differentials,
drivetrains, or any parts thereof. This use includes muffler shops, auto repair garages, tire repair and
installation, wheel and brake shops, and similar repair and service activities but excludes body shops,
dismantling or salvage.” (Section 17-2-2., (14), (d)).
Finally, the 2022 Regional Comprehensive Plan designates this area as Neighborhood Mixed Use. These
areas are intended to accommodate small-scale commercial activity and neighborhood-supportive services in
historic hubs of the City. Rezoning to B-3 would fit the intent of the Comp Plan by providing auto repair
services to the surrounding neighborhood.

Site Character: The site is developed with an approximate 1,800 square footcommercial
building in the northwest corner of the lot, abutting the alley.
