HomeMy WebLinkAbout10919 City Clerk's Office Item # R1 Background Paper for Proposed Ordinance COUNCIL MEETING DATE: March 24, 2025 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Carla Sikes, City Attorney SUBJECT: AN ORDINANCE APPROVING, AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT TO BUY AND SELL REAL ESTATE BY AND BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND ERIKA ALMEIDA-TRUJILLO, FOR THE SALE OF PROPERTY DESCRIBED AS 101 WEST RIVERWALK PLACE, UNITS 1A AND 1B WITHIN THE CITY OF PUEBLO SUMMARY: Attached for consideration is an Ordinance authorizing the Mayor to execute a Contract to Buy and Sell Real Estate between the City of Pueblo and Erika Almeida-Trujillo for the PREVIOUS COUNCIL ACTION: None. BACKGROUND: Erika Almeida-Trujillo has offered to purchase the ground floor condominium, Units 1A and 1B, of 101 W. Riverwalk Place. Her intent is to open a Wellness Center with a gym/smoothie shop in Unit 1A and a Rehabilitation/Wellness Center and ENT medical clinic in Unit 1B. These businesses will be open to the public. The total purchase price is $1,200,000 with $300,000 in concessions to be returned to the Buyer for necessary tenant finish. The purchase price is consistent with an appraisal the City received on the Property in January 2025. The sale is anticipated to close on or before June 26, 2025. FINANCIAL IMPLICATIONS: If approved, the City would receive a net total of $900,000 for the Property. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: City Council could decide not to pass the attached Ordinance and thus, not purchase the Property. RECOMMENDATION: Approval of the Ordinance. ATTACHMENTS: 1. The Contract to Buy and Sell Real Estate ("Contract") between the City of Pueblo, a Colorado Municipal Corporation, and Erika Almeida-Trujillo, a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved. The Mayor is hereby authorized to execute said Contract for and on behalf of the City of Pueblo and the City Clerk's Office is authorized to affix the seal of the City thereto and attest same. SECTION 2. The officers of the City are authorized to perform any and all acts consistent with this Resolution to implement the policies and procedures described herein. SECTION 3. This Ordinance shall become effective immediately upon the date of final action by the City Council and the Mayor.
