AN ORDINANCE APPROVING A SPECIAL AREA PLAN
AMENDMENT FOR THE RANCHO DEL SOL 5TH FILING, A
SPECIAL AREA PLAN
WHEREAS, a request for a Special Area Plan Amendment for the Rancho Del Sot 5th
Filing, A Special Area Plan, has been submitted to the Planning and Zoning Commission for
approval pursuant to Section 17-4-29 of the Pueblo Municipal Code, and,
WHEREAS, the Planning and Zoning Commission after a public hearing found and
determined the objectives and requirements of said Section 17-4-29 can and will be met, and,
WHEREAS, the Planning and Zoning Commission has recommended the approval of the
Amendment to the Rancho Del Sol 5th Filing, A Special Area Plan; NOW, THERFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Special Area Plan for:
PARCELS A, B, C, D, AND E, RANCHO DEL SOL FIFTH FILING
REARRANGEMENT OF PROPERTY BOUNDARIES, RPB-24-06
CITY AND COUNTY OF PUEBLO, STATE OF COLORADO.
attached hereto, is hereby approved.
SECTION 2.
The Amendment to the Rancho Del Sol 5th Filing,A Special Area Plan is approved without
conditions.
SECTION 3.
This Ordinance shall become effective immediately upon final passage and approval.

Introduced and initial adoption of Ordinance by City Council on February 24, 2025.

SUBJECT: AN ORDINANCE APPROVING A SPECIAL AREA PLAN AMENDMENT
FOR THE RANCHO DEL SOL 5TH FILING, A SPECIAL AREA PLAN
SUMMARY:
The applicant is requesting approval of a Special Area Plan Amendment for Lots 6
through 9, Block 1, of Rancho Del Sol 5th Filing, which rearranges property lines and
building envelopes to avoid a drainage swale and facilitate development of new

administratively.
PREVIOUS COUNCIL ACTION:

On March 27, 1995, City Council approved Ordinance No. 5949 approving the Rancho

Del Sol 5 Filing, Special Area Plan.
BACKGROUND:
Rancho Del Sol 5th filing was platted in 1995 and consists of 22 lots spread across three
Blocks and one common Parcel A. The proposed Special Area Plan amendment will
affect Lots 6-9, Block 1, and Parcel A, the common ingress/egress and public utility
easement. There are no proposed changes to Blocks Two, Block Three, or the exterior
boundary of the development site. As plated, the subject lots are staggered, placing the
building envelopes in an established drainage swale, making development of the lots
extremely challenging. The applicant is requesting permission to bring the front lot lines
to the north, closer to the street, moving them out of the drainage swale to facilitate
development of five single-family attached structures. As platted, the subject Lots 6-9
are between 3,107 sq ft and 4,333 sq ft and are staggered, creating the appearance of
a variable setback from the back of sidewalk, adjacent to Tierra Berienda. The proposed
rearrangement and SAP amendment will create a uniform 20-foot setback from Tierra
Berienda for Lot 5 and the proposed Parcels B, C, and D. Parcel E, located on the corner
of Tierra Berienda and Del Norte, is proposed to setback 25-feet from Tierra Berienda
and Paseo Del Norte. The proposed lot arrangement will deviate from the established
staggered setback pattern; however, this is the most efficient and cost-effective way for
the developer to construct homes due to the existing rip rap and drainage swale located
south of the lots.
FINANCIAL IMPLICATIONS:
None.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their December 11th, 2024 Regular Meeting,
voted 5-0 to recommend approval, Commissioners Maestri and Pasternak absent.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission Public
Hearing to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public
Hearing.
ALTERNATIVES:
If City Council does not approve this Ordinance, the applicant will not be able to modify
lot lines to allow a rearrangement of property boundaries.
Upon request of City Council, the Ordinance could be returned to the Planning and
Zoning Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Ordinance.
