HomeMy WebLinkAbout6356RESOLUTION NO. 6356 A RESOLUTION PROVIDING FOR THE CREATION OF A SPECIAL IMPROVEMENT DISTRICT IN THE CITY OF PUEBLO, COLORADO, TO BE KNOWN AS SPECIAL IM- PROVEMENT DISTRICT NO. 89 -1 WHEREAS, any public work or improvement, the cost of which is to be assessed in whole or in part to the property benefited thereby, whether or not requested by property owners affected thereby, may be initiated by the City Council upon finding that the public health, safety and welfare, in addition to benefits to the property to be assessed, require the building of such im- provement; and WHEREAS, the City Council of the City of Pueblo has been informed that the public health, safety and welfare require the creation of a Special Improvement District in which there shall be constructed and installed alley improvements and appurtenances, consisting, generally, of concrete double gut- ter, hot -mixed bituminous pavement, gravel base and sub -base materials, and miscellaneous items incidental thereto; and WHEREAS, such improvements are to be constructed and installed on and in public alleys located in the City of Pueblo, County of Pueblo and State of Colorado, which alleys are designated as follows: 89 -1 -1 Alley from the East gutter line of Greenwood Street to a point 196 feet east, between West 13th Street and West 14th Street. 89 -1 -2 Alley from the East gutter line of Argyle Street to the West gutter line of Castle Street. Alley from the West gutter line of Newman Avenue to the East property line of Dupps Avenue. WHEREAS, the construction and installation of such improvements will confer special benefits on the real property within said district and will bene- fit the property abutting upon the alleys to be improved; and WHEREAS, the construction and installation of such improvements will confer general benefits to the City at large; and WHEREAS, the City Council has determined that the City of Pueblo shall contribute fifty percent (50 %) of the total cost of such improvements; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: 1. The City Council hereby finds and determines that the public health, safety and welfare, in addition to benefits to the property to be as- sessed, and the general benefits to the City at large, entirely justify the creation of Special Improvement District No. 89 -1 and the improvements to be constructed and installed therein, all in full conformity with the Charter and Chapter l of Title 12 of the 1971 Code of Ordinances of said City. 2. Said improvements shall consist of improvements, and incidentals thereto, on the alleys specified above. 3. Said Special Improvement District No. 89 -1 shall consist of the lots and lands directly abutting on the alleys to be improved, and the cost of said improvements shall be assessed against said property specifically benefited, and pursuant to the Charter and Chapter 1 of Title 12 of the 1971 Code of Ordi- nances of said City. 4. The Director of Public Works be, and he is hereby authorized and - 2 - directed to proceed with surveys of those parts and portions of the City of Pueblo to be included within the proposed Special Improvement District No. 89 -1, and file in his office details of such survey, consisting of the plans and specifications for the improvements to be constructed and installed in the proposed district showing exterior boundaries and all streets, avenues, al- leys, public places, lots and blocks within the same, his schedule showing the approximate amounts of said cost to be apportioned to and assessed upon each lot or parcel of land in said district, such costs to be apportioned and as- sessed upon each lot or parcel in said district in proportion to benefits ac- cruing thereto, all such apportionments and assessments to be estimated and made in accordance with the provisions of the Charter and Chapter 1 of Title 12 of the 1971 Code of Ordinances of said City.
