A RESOLUTION RATIFYING THE AWARD OF AN EMERGENCY
CONSTRUCTION CONTRACT IN THE AMOUNT OF $32,952.50
TO RUSS GRADING & EXCAVATING LLC, A COLORADO
LIMITED LIABILITY COMPANY, FOR PROJECT NO. 23-040
(SWAN03) - FOR EMERGENCY STORM SEWER POINT REPAIR
AT THE INTERSECTION OF BERKLEY AVENUE AND SMALL
AVENUE AND APPROVING A CHANGE ORDER IN THE
AMOUNT OF $14,849.10 FOR ADDITIONAL WORK AND
MATERIALS, AND AUTHORIZING AND APPROVING THE
PURCHASING AGENT'S EXECUTION OF THE SAME
WHEREAS, an emergency storm sewer repair was authorized by the Mayor in accordance
with Section 1-10-5 of the Pueblo Municipal Code; and
WHEREAS, the point repair work was awarded to Russ Grading & Excavating LLC, under
the 2023-2026 Storm Sewer Point Repair contract: NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that
SECTION 1.
City Council hereby ratifies and approves the contract for the emergency repair of the
storm sewer at the intersection of Berkley Avenue and Small Avenue with Russ Grading &
Excavating LLC, Project No. 23-040 (SWAN03) awarded to said bidder in the amount of
$47,801.60 which amount includes all contract change orders.
SECTION 2.
Funds for Project No. 23-040 (SWAN03) Emergency Storm Sewer Point Repair at the
intersection of Berkley Avenue and Small Avenue shall be paid from the Stormwater Utility Fund
Project Account SWAN03, Point Repairs & Pipe Cleaning.
SECTION 3.
The Purchasing Agent was authorized to execute said contract on behalf of Pueblo, a
Colorado Municipal Corporation, and the City Clerk properly affixed the seal of the City thereto
and attested the same.
SECTION 4.
The officers and staff of the City are authorized to perform any and all acts consistent with
the intent of this Resolution and the contract to implement the transactions described therein.
Furthermore, all actions previously taken by officers and staff of the City consistent with the
contract including any payments authorized under the contract and the contract change order in
the amount of $47,801.60 are hereby ratified.
SECTION 5.
This Resolution shall become effective immediately upon passage and approval.

SUMMARY:
This Resolution ratifies and approves the award of a construction contract in the amount
of $32,952.50 to Russ Grading & Excavating LLC, under Contract No. 23-040 for an
emergency storm sewer point repair at the intersection of Berkley Avenue and Small
Avenue and approves a change order in the amount of $14,849.10.
PREVIOUS COUNCIL ACTION:
On 8/14/2023 City Council passed Resolution #15335, which approved the award of the
2023-2026 Storm Sewer Point Repair Contract to multiple contractors which were
qualified via competitive bid.
BACKGROUND:
Stormwater Utility was notified of a small sinkhole at the intersection of Berkley Avenue
and Small Avenue. A visual inspection of the inlet and pipe was done. A Closed Caption
Television (CCTV) inspection could not be conducted because the pipe was collapsed,
and the camera would not fit inside the stormwater pipe. The visual inspection of the inlet
and pipe on the southwest corner revealed damage, and they would both need to be
replaced. An emergency point repair was required to repair the inlet and pipe at the
intersection.
The contract with the unit prices for the estimated work performed by Russ Grading &
Excavating LLC. can be found attached. This work was performed under the 2023-2026
Storm Sewer Point Repair Resolution #15335 which contractors were qualified via
competitive bid.
FINANCIAL IMPLICATIONS:
Funding in the amount of $47,801.60 will be paid from the Stormwater Utility budget.
Project Account SWAN03, for Point Repairs and Pipe Cleaning.
