HomeMy WebLinkAbout10906 City Clerk's Office Item # R5 Background Paper for Proposed Ordinance COUNCIL MEETING DATE: February 24, 2025 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Carla Sikes, City Attorney SUBJECT: AN ORDINANCE APPROVING A LEASE AGREEMENT BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION AND PUEBLO STEAM WORKS DBA SOUTHERN COLORADO SCIENCE CENTER DBA LEONARDO DA VINCI MUSEUM OF NORTH AMERICAN, A COLORADO NONPROFIT CORPORATION FOR THE PROPERTY LEGALLY DESCRIBED AS LOT 4 BLK 1 PUEBLO CENTER SUBDIVISION # 3 AND AUTHORIZING THE MAYOR TO EXECUTE THE SAME SUMMARY: Attached is an Ordinance approving and authorizing the Mayor to execute a Lease Agreement between the City of Pueblo STEAM Works DBA Southern Colorado Science Center DBA Leonardo da Vinci legally described as Lot 4 Blk 1 Puebl PREVIOUS COUNCIL ACTION: None. BACKGROUND: The Museum seeks to bring the Leonardo da Vinci Museum of North America to Pueblo. art and machines in North America pursuant to a ten-year exclusivity agreement with the Artisans of Florence, Italy, who own the rights to the works. In addition, the Museum will house a STEAM Works interactive exhibit. The Museum will attract international, Riverwalk. The Museum is working with the Pueblo Urban Renewal Authority to rent that portion of the Pueblo Convention Center formerly known as the PBR University for the exhibition hall. The Museum wants to open an outdoor café and lease 1,200 square feet of the sidewalk area adjacent to the Convention Center and owned by the City for that purpose. This Lease is contingent on the Museum entering into the lease with Pueblo Urban Renewal for the exhibit space. The initial lease term is ten years with an option to renew for two additional ten-year terms. The rent will be abated for the first year. The Museum will pay gross rent of $8.00 per square foot beginning in year two with rent increases each year beginning in year five. FINANCIAL IMPLICATIONS: The Lease will result in income to the City in the amount of not less than $9,600 annually beginning in 2026. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: If this Ordinance is not approved, the Museum would not lease the space. RECOMMENDATION: Approve the Ordinance. ATTACHMENTS: 1. The proposed Lease Agreement between the City of Pueblo, a Colorado Municipal Corporation and Pueblo STEAM Works DBA Southern Colorado Science Center DBA Leonardo da Vinci Museum of North American, a Colorado nonprofit corporation, a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved. The Mayor is authorized to execute and deliver the lease in the name of the City and the Acting City Clerk is directed to affix the seal of the City thereto and attest same. SECTION 2. The officers and staff of the City are authorized and directed to perform any and all acts consistent with this Ordinance and the attached Lease which are necessary or desirable to effectuate the transactions described therein. SECTION 3. This Ordinance shall become effective on the date of final action by the Mayor and City Council.
