SUBJECT: AN ORDINANCE APPROVING THE 1ST AMENDMENT TO THE
INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF
PUEBLO, A COLORADO MUNICIPAL CORPORATION ("CITY"), AND
THE STATE OF COLORADO, ACTING BY AND THROUGH THE
COLORADO DEPARTMENT OF TRANSPORTATION ("CDOT"),
PROJECT BRO M086-079 (22616) FOR THE MEL HARMON BRIDGE
OVERLAY AND REHABILITATION PROJECT, BUDGETING AND
APPROPRIATING FUNDS IN THE AMOUNT OF $797,179 AND
AUTHORIZING THE MAYOR TO EXECUTE SAME
SUMMARY:
This Ordinance approves the 1st Amendment of an Intergovernmental Agreement
Harmon Drive Bridge Overlay and Rehabilitation Project, and budgets and appropriates
funds in the amount of an additional $797,179.
PREVIOUS COUNCIL ACTION:
Ordinance 9205 (November 27, 2017) adopted the City of Pueblo 2018 Budget, which
budgeted $150,000 for this project (HU1802).
Ordinance 9373 (November 26, 2018) adopted the City of Pueblo 2019 Budget, which
budgeted an additional $300,000 for the same project.
Ordinance 9618, (December 26, 2019) approved an intergovernmental agreement
between the City of Pueblo and the State of Colorado, accepted grant funds from FHWA
and budgeted and appropriated funds in the amount of $418,701.00 with a local match
of $104,675.
BACKGROUND:
The Mel Harmon Drive Bridge was constructed in 1976. It spans Pueblo Mall Drive and
Union Pacific Railroad Tracks. Recent Bridge Inspection Reports have recommended
that rehabilitation shall include the following tasks to preserve the structure: resurface
the bridge deck, address settlement issues/mud jack slope pavement, remove and
replace noncompliant bridge railing, modify approach rails, remove and replace
damaged curb and gutter and sidewalk, remove vegetation, etc.
In 2018, the City was awarded a grant from the FHWA in the amount of $418,701 to aid
in the rehabilitation of this bridge. The source of the funds that were budgeted and
appropriated in the 2018 and 2019 City of Pueblo annual budget is the FASTER Bill
This Ordinance approves the 1st Amendment to the Intergovernmental Agreement
originally effective on January 29, 2020, between the City and CDOT. This amendment
is due to the addition of funds in the amount of $797,179 due to the engineers estimate
exceeding the amount of funding available.
FINANCIAL IMPLICATIONS:
Funds in the amount of $797,179 shall be budgeted and appropriated for Project HU1802
Mel Harmon Drive Bridge Overlay and Rehabilitation from the additional funding from the
State of Colorado grant.
BOARD/COMMISSION RECOMMENDATION:
None.
STAKEHOLDER PROCESS:
None.
ALTERNATIVES:
Denial of this Ordinance would deny the additional funding from the State of Colorado.
RECOMMENDATION:
Approve the Ordinance.

BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
a Colorado Municipal Corporation, and State of Colorado, acting by and through the Colorado
Department of Transportation (CDOT), Project: BRO M086-079 (22616), Mel Harmon Drive Bridge
Overlay and Rehabilitation, a copy of which is attached, having been approved as to form by the City
Attorney, is hereby approved.
SECTION 2.
The Mayor is authorized to execute and deliver the IGA 1st Amendment in the name of
the City of Pueblo and the City Clerk is directed to affix the seal of the City thereto and attest
same.
SECTION 3.
Subject to encumbrances by the Colorado State Department of Transportation, funds from
the Mel Harmon Drive Bridge Overlay and Rehabilitation (22616) in the amount of $797,179 are
hereby budgeted and appropriated for the Mel Harmon Drive Bridge Overlay and Rehabilitation
No. HU1802.
SECTION 4.
The officers of the City are authorized to perform any and all acts consistent with this
Ordinance to implement the policies and procedures described herein.
SECTION 5.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.
