HomeMy WebLinkAbout6348RESOLUTION NO. 6348 A RESOLUTION AUTHORIZING THE EXECUTION OF A SUPPLEMENTAL AGREEMENT WITH LONCO, INC., FOR PROFESSIONAL SERVICES CONCERNING THE SOUTH UNION AVENUE BRIDGE REHABILITATION BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: UrTMN 1 The second Supplemental Agreement between the City of Pueblo and Lonco, Inc., the original of which is on file in the office of the City Clerk and is made a part hereof by reference, for professional services in performing engineering design and inspection services for the rehabilitation of the South Union Avenue Bridge, for additional compensation estimated to be $15,000, with such terms as the City Manager may require, and upon approval as to form by the City Attorney, be and hereby is authorized and approved. gFrTTnN 7 The City Manager is hereby authorized to execute said Agree- ment on behalf of the City of Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the same. INTROD'U'CED March 27 ,1989 By MIKE SALARDINO ouncliman APPROVED: resident of the Council ATTEST: City Jerk - 2 - 1987 BRIDGE REHABILITATION PROGRAM FOR UNION AVENUE BRIDGE SUPPLEMENTAL CONTRACT FOR CHANGE OF SCOPE OF SERVICE THIS SECOND SUPPLEMENTAL CONTRACT, made this 7' day of R , 1989, by and between the City of Pueblo, hereinafter referred to as the City, and LONCO, INC., 2680 Eighteenth Street, Denver, CO 80211, hereinafter re- ferred to as the Engineer. WHEREAS, authority exists in the Law and Funds have been budgeted, appro- priated and otherwise made available, and a sufficient unencumbered balance thereof remains available for payment. WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate agencies; and WHEREAS, the City and the Engineer have heretofore entered into a contract dated September 22, 1986, hereinafter referred to as the basic contract, and made a part hereof by reference, which provides for design services for re- habilitation of the existing bridge on Union Avenue over the Arkansas River and Railroad track in Pueblo, Colorado; and WHEREAS, the parties hereto now desire to amend the basic contract with respect to the revision in scope of work as described in the letter dated October 3, 1988, from William E. Hamouz, P.E. to Tom Cvar, a copy of which is attached hereto and incorporated herein; and WHEREAS, these changes have substantially increased the effort on the part of the Engineer to complete the work, it is therefore deemed by the City to be in the best public interest to supplement the basic contract. NOW, THEREFORE it is hereby agreed that: A. The basic contract, unless specifically revised or amended herein, shall be and remain in full force and effect with respect to the contractual relationship between the parties hereto. B. ARTICLE III, Section 1, amend the fees as follows: 1) Paragraph A delete the figure $26,000.00 and replace with the figure $30,000.00. 2) Paragraph B delete the figure $40,000.00 and replace with the figure $55,000.00. 3) Paragraph C delete the figure $70,000.00 and replace with the figure $85,000.00. October 3, 1988 City of Pueblo Department of Public Works 211 V Street Pueblo, Colorado 81003 ATTENTION: Mr. Tom Cvar, Director of Public Works REFERENCE: BRM 3101(1), South Union Avenue at Railroad, Pueblo LONCO No. 8771.01 Dear Tom: This letter is to provide you with the justification for the extra work that was incurred by us during the later portions of construction phase of the Union Avenue Bridge Rehabilitation Project, this year. Four major events created additional work for us during this project. 1. TRUSS #3 REPAIR -This item caused extra time for us after the contractor damaged the downstream truss during the first jacking operation for bearing replacement. AFter the damage was discovered, several meetings took place at the site with the contractor and his engineer. It was also necessary for us to review shop drawings, welding inspection, and construction inspection of the truss upgrade. Also, the addition of steel to the opposite side of the pier, which was added to balance the appearance of the downstream trusses, added extra time. Time for this extra work was estimated at 75 hrs. 2. ADDITIONAL WELD QUALITY ASSURANCE -This item created additional work when it was learned that the contractor was not utilizing the visual inspector during the welding of the upstream trusses. Several code inadequate welds were discovered on the upstream trusses and this required us to utilize an additional engineer to make a quality assurance inspection on the new welds on the upstream trusses. This led to removal and rewelding of several areas on the upstream trusses and an inspection of the rewelded portions. Based on the inadequate welds found in the upstream trusses, it was felt that the downstream trusses should also be looked at and this entire process was repeated for the downstream trusses. Time for this extra work estimated at 55 hours. TING ENGINEERS 2680 EIGHTEENTH STREET DENVER, COLORADO 80211 (303) Mr. Tom Cvar October 3, 1988 Page 2 3. EXTRA CONSTRUCTION ENGINEERING FOR THE ADDED PAVING WORK -The additional roadway pavement removal and restoration added an additional month of time to the project. The Project Engineer was required to be present for all of the additional work as required by the specifications, calling for frequent inspections and approvals during the asphalt removal, membrane installation, asphalt paving, and plant mix seal coat paving. Time for this extra work estimated at 145 hours. 4. The inability of the Contractor to make himself available for timely signing of routine paperwork and the monthly and final pay requests has created additional work in order to keep him informed as required by the standard specifications. We believe that the Contractor will continue to stay unavailable and anticipate a drawn -out finalization of this project. We have been and will continue to keep as much pressure on the Contractor in order to get this project finalized, however, the standard specifications limit us to what we can do. Time estimated for this additional work is 55 hours. The total increase in time necessary is 330 hours at ;45.00 /hr = $14,850 plus expenses of $250 = $15,000 If you have any comments or questions concerning the enclosed material, please call me.
