A RESOLUTION ENDORSING POSADA'S APPROVAL AS AN
ORGANIZATION TO NEGOTIATE AND EXECUTE LEASES
OF HUD -OWNED SINGLE FAMILY PROPERTIES FOR USE
AS TEMPORARY TRANSITIONAL HOUSING FOR THE
HOMELESS
WHEREAS, Posada has represented to the City that it is a non-
profit organization qualified to enter into leases of HUD -owned
vacant single family properties available for use as temporary
shelter for the homeless, and
WHEREAS, Posada has requested the City to endorse Posada's
approval as an organization to negotiate and execute leases for
eligible vacant single family acquired properties held by HUD
located within the City of Pueblo to be used as temporary
transitional housing for the homeless. NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1
The City Council of the City of Pueblo does hereby endorse
Posada's approval as an organization to negotiate and execute
leases for eligible vacant single family acquired properties held
by the Department of Housing and Urban Development ( "HUD ") and
located within the City of Pueblo, Colorado, to be used as
temporary transitional housing for the homeless, subject to and
contingent upon:
a. The single family properties and their use as temporary
transitional housing for the homeless shall meet and comply with
all applicable ordinances and codes of the City including without
limitation, zoning ordinances and housing and building codes.
b. Posada shall assume and be obligated for all legal,
financial and programmatic responsibilities for all properties
leased from HUD and the City shall not in any manner be or become
liable or responsible with respect to such properties or Posada's
program or any costs or expenses relating to or associated with
the properties or Posada's program.
C. Posada shall be responsible for repairs, maintenance,
utilities, taxes, and hazard and general liability insurance for
the properties and all other costs and expenses relating to or
associated with the properties and Posada's program.
d. The properties shall be made available for a period from
three to twelve months to one or two - parent homeless families who
have resided within the City for a minimum period of six months.
e. The homeless family's need and program eligibility will
be determined by a committee appointed by Posada's Board of
Directors and the homeless family will be required to pay a
monthly occupancy charge to offset the costs of insurance,
utilities, taxes and property management.
f. The homeless family shall have the desire to become
self- sufficient and must agree to participate in living skills and
counseling programs that assist the family in becoming self -
sufficient.
g. The properties to be leased will be selected based upon
the condition of the property and accessibility to schools, bus
routes, food stores, and support services.
h. The properties to be leased will be inspected for code
violations and needed repairs and renovation by qualified

individuals. All necessary repairs to and renovation of the
properties shall be made before a qualified homeless family
occupies the property.
i. Posada shall develop programmatic and fiscal guidelines
for its program not inconsistent with this Resolution and submit
periodic reports to the City at least quarterly.
SECTION 2
This Resolution shall become effective upon final adoption.
