HomeMy WebLinkAbout6282RESOLUTION NO. 6282 A RESOLUTION FINDING SUBSTANTIAL COMPLIANCE WITH COLORADO REVISEDSTATUTES SECTION 31 -12- 107 (1) OF THE PETITION FOR ANNEXATION OF THE AREA COMMONLY KNOWN AND DESCRIBED AS U.S. HIGH- WAY 50 RIGHT -OF -WAY FROM PRESENT CITY LIMITS LINE EAST TO 302 LANE WHEREAS, a Petition For Annexation of the area described in Section 1 hereof has been filed with the City Clerk, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. The Petition For Annexation of the following described area situated in Pueblo County, Colorado, is hereby found and determined to be in substan- tial compliance with the provisions of C.R.S. §31 -12- 107(1); AREA NO. 1: A portion of the Right -of -Way of U.S. Highway No. 50 (U.S. Highway No. 96) in the S2 of the SE4 of Section 28 and in the N2 of the NE- of Section 33, Township 20 South, Range 64 West of the 6th P.M., being more particularly described as follows: Beginning at a point on the Present City Limits Line, said point being the intersection of the South Right -of -Way line of said U.S. Highway No. 96 and the West line of the E2 of the E2 of said Section 33; thence North, along said West line, and along the said Present City Limits Line, to the North Right -of -Way line of said U.S. Highway No. 96; thence Easterly, along said North Right - of -Way line, to the South Right -of -Way line of said U.S. Highway No. 50; thence Westerly, along said South Right -of -Way line, to the West line of the E2 of the E2 of said Section 28; thence North, along said West line and along the said Present City Limits Line, to the North Right- of-Way line of said U.S. Highway No. 50; thence Southeasterly, along said North Right -of -Way line, to the East line of said Section 33; thence Northwesterly, to the Southwest corner of Block 12 in Belle Plain Subdivision, according to the recorded plat thereof, filed for record June 20, 1952; thence South, along the West line extended of said Block 12, to the said South Right -of -Way line of U.S. Highway No. 50 (U.S. Highway No. 96); thence North- westerly, along said South Right -of -Way line, to the Point of Begin- ning. At Least one -sixth of the boundary of the land described above is Existing City Limits Line. -1- AREA N0. 2: A portion of the Right -of -Way of U.S. Highway No. 50 in the N 1 - 2 of the NE 4 of Section 33 and in the N 1 - 2 of the NW '- of Section 34, Township 20 South, Range 64 West of the 6th P.M., being more particularly described as follows: Beginning at a point on the Present City Limits Line, said point being the Southwest corner of Block 12 in Belle Plain Subdivision, according to the recorded plat thereof, filed for record June 20, 1952; thence Southeasterly, along the Present City Limits Line, to the intersection of the North Right -of -Way line of U.S. Highway No. 50 and the East line of said Section 33; thence Southeasterly, along said North Right -of -Way line, to the East line of the W2 of the said NW4 of Section 34; thence South, along said East line, to the center- line of the said U.S. Highway No. 50 Right -of -Way; thence Northwesterly, along said centerline, to the Present City Limits line and the West line extended of said Block 12 in Belle Plan Subdivision; thence North, along said West line extended and the Present City Limits Line to the Point of Beginning. At least one -sixth of the boundary of the land described above, is Existing City Limits Line. AREA N0. 3: A portion of the Right -of -Way of U.S. Highway No. 50 in the NZ of the NE4 of Section 33, the NZ of the N2 of Section 34 and in the S2 of the SE4 of Section 27, Township 20 South, Range 64 West of the 6th P.M., being more particularly described as follows: Beginning at a point on the Present City Limits Line, said point being the intersection of the South Right -of -Way line of U.S. Highway No. 50 and the West line extended of Block 12 in Belle Plain Subdivision, accord- ing to the recorded plat thereof, filed for record June 20, 1952; thence along said Present City Limits Line, the following three (3) courses: 1. North, along the said West line extended of Block 12 to the center line of the said U. S. Highway No. 50 Right -of -Way; 2. Southeasterly, along said centerline, to the East line of the W2 of the NW- of said Section 34; 3. North, along said East line, to the North Right -of -Way line of said U. S. Highway No. 50; thence Easterly, along said North Right -of -Way line, to the East line of said Section 27; thence South, along said East line to the Southeast corner of said Section 27 and the South Right -of -Way line of said U.S. Highway No. 50; thence Westerly, along said South Right -of -Way line, to the Point of Beginning. At Least one -sixth of the boundary of the land described above is Existing City Limits Line. -2- AREA N0. 4: A portion of the Missouri Pacific Railroad Company Right -of -Way deeded to the State Department of Highways, Division of Highways, State of Colorado by deed recorded in Book 1848 at Page 793 of the Pueblo County Records in the NE4 of the NW4 and the NW- of the NE-4 of Section 34, in the S2 of the SE- of Section 27 and in the S2 of the S2 of Section 26, Township 20 South, Range 64 West of the 6th P.M., being more particularly described as follows: Beginning at a point on the Present City Limits Line and the North Right -of -Way line of U.S. Highway No. 50, said point being the intersection of the East line of said Section 27 and the South line of said Railroad Right -of -Way; thence Southwesterly, along said South Right -of -Way line, the said North Right -of -Way line of U.S. Highway No. 50 and along the said Present City Limits Line, to the Southwest corner of Tract No. 2, as described in said Book 1848 at Page 793 of the Pueblo County Records; thence along the boundary of said Tract No. 2, the following two (2) courses: 1. Northwesterly, a distance of 100 feet to the Northwest corner of said Tract No. 2 and the North line of the said Railroad Right -of -Way; 2. Easterly, along said North Right -of -Way line, to the East line of said Section 26; thence South, along said East line, a distance of 100 feet, to the South line of said Railroad Right -of -Way and the said North Right -of Way line of U.S. Highway No. 50; thence West, along said Right -of- Way line to the Point of Beginning. At Least one -sixth of the boun- dary of the land described above is Existing City Limits Line. AREA N0. 5:_ portion of the Right -of -Way of U.S. Highway No. 50 and a portion of the Missouri Pacific Railroad Company Right -of -Way deeded to the State Department of Highways, Division of Highways, State of Colorado by deed recorded in Book 1848 at Page 793 of the Pueblo County Records in the S2 of the S2 of Section 26, in the S2 of the S4 of Sec- tion 25 and in the N2 of the NE- of the NW4 and the N2 of the NW-4 of the NE- of Section 36, Township 20 South, Range 64 West of the 6th P.M., being more particularly described as follows: Beginning at a point on the Present City Limits Line and the South Right -of -Way line of said U.S. Highway No. 50, said point being the Southwest corner of said Section 26; thence along said Present City Limits Line, the following three (3) courses: 1. North, along the West line of said Section 26, to the said North Right -of -Way line of U.S. Highway No. 50; 2. East, along said North Right -of -Way line, to the East line of said Section 26; 3. North, along said East line, a distance of 100 feet, to the North line of the said Railroad Right -of -Way; -3- thence East, along said North Right -of -Way line, to the East Right - of -Way line extended of 302 Lane; thence South, along said East Right -of -Way line extended, to the South Right -of -Way line of said U.S. Highway No. 50; thence Westerly, along said South Right -of -Way line, to the Point of Beginning. At least one -sixth of the boundary of the land described above is Existing City Limits Line. gPrTTnM 9 A public hearing to determine if the area proposed to be annexed meets the applicable requirements of C.R.S. §31 -12 -104 and §31 -12 -105 to establish eligibility for annexation under the Municipal Annexation Act of 1965 shall be held before the City Council in Council Chambers, Second Floor, City Hall, One City Hall Place, Pueblo, Colorado, on Monday, November 14, 1988, commencing at 7:30 o'clock p.m. or as soon thereafter as City Council business allows. The City Clerk shall publish notice of the public hearing once a week for four successive weeks in The Pueblo Chieftain. The first publication of such notice shall be at least thirty (30) days prior to the date of the hearing. A copy of the published notice, together with a copy of the Petition For Annexation, shall be sent by registered mail by the City Clerk to the Board of County Commissioners and the County Attorney of Pueblo County and to any school district or special district having territory within the area to be annexed at least twenty -five days prior to the date of the hearing.
