A RESOLUTION ACCEPTING AN EASEMENT FROM
THE SISTERS OF CHARITY OF CINCINNATI
WHEREAS, the Sisters of Charity of Cincinnati, on June 29, 1972,
granted an easement to the City of Pueblo; and
WHEREAS, such easement is necessary to construct a public park-
ing area and sidewalk along the south side of Lakeview Avenue, and has been
approved as to form by the City Attorney; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:

The easement granted by The Sisters of Charity of Cincinnati
dated June 29, 1972, which easement is on file with the City Clerk, is here-
by approved and accepted.

The City Clerk is directed to record said easement in the office of
the Pueblo County Clerk and Recorder.

KNOW ALL MEN BY THESE PRESENTS: that the undersigned,
Sisters of Charity of Cincinnati
hereinafter called the "Grantor ", in consideration of the sum of One
Dollar and other good and valuable considerations, to the undersigned
in hand paid by the City of Pueblo, Colorado, the receipt whereof is
hereby acknowledged, hereby grants to Pueblo, a municipal corporation
organized and existing as a home rule city under Article XX of the
Constitution of the State of Colorado, hereinafter called the
"Grantee ", its successors and assigns, the easement or right of way
to construct and maintain a sidewalk, driveways, and related parking
for the public convenience over a strip of land owned by the Grantor
in the County of Pueblo, State of Colorado, described as follows:
A parcel of land being within the SA of Section 12,
Twp. 21 South, Range 65 West of the 6th P.M., a portion
of Lot 8, Block 43, in Uplands Park, according to the
recorded plat thereof, filed for record February 19, 1886,
and being more particularly described as follows:
Beginning at the southwest corner of Lot 25, according
to the recorded plat of Vauxhall Place, filed for
record July 19, 1890, saod point also being the inter-
section of the south line of Lakeview Avenue and the
east line of Lake Avenue; thence easterly along said
south line of Lakeview, also being the south line of
Vauxhall Place, a distance of 984 feet, more or less,
to a point on the easterly line of Cypress Avenue;
thence southerly, a distance of 16.5 feet; thence westerly
a distance of 984 feet, more or less, to a point on said
east line of Lake Avenue; thence north, 16.5 feet to the
point of beginning. Containing .37 acres, more or less,
together with the right of ingress to and egress from said strip of
land for the foregoing purposes.

TO HAVE AND TO HOLD said strip of land for so long as the
same shall be used for the purposes aforesaid, said easement or
right of way to cease if and when said strip of land shall cease
to be used for said purposes.
The Grantor covenants and agrees for itself, its successors
and assigns, not to erect any building or structure within the limits
of said strip of land, and the Grantee, its successors and assigns,
shall have the right to remove objects interfering with the construction,
maintenance, control, and use of said sidewalk, driveways, and
related parking.
The Grantor also reserves the right to use, maintain, and
repair all structures, service lines and driveways presently located
within this easement.
The easement or right of way hereby granted is subject to the
right of the Grantor, its successors and assigns, to pass over, across,
along and upon said strip of land and otherwise use the surface
thereof, provided such passage and use shall not be inconsistent or
interfere with the use of said strip by the Grantee, its successors
and assigns, for the purposes aforesaid.
IN WITNESS WHEREOF the Grantor has hereunto caused its
name and seal to be hereunto affixed, this
