HomeMy WebLinkAbout6246RESOLUTION NO. 6246 A RESOLUTION AUTHORIZING THE ACQUISITION OF CERTAIN REAL PROPERTY LOCATED ON AND ADJOINING THE SOUTHERN TIP OF SMELTER HILL BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. The City Manager is hereby authorized to take such action as may be necessary to acquire from Charles F. Morgan, as owner, the real property located in the City of Pueblo, County of Pueblo and State of Colorado, and described particularly in Attachment "A" hereto for a sum not to exceed $40,000 including, without limitation, the execution of a contract for the purchase of the real property. Covering the Land in the State of Colorado, County of Pueblo Described as: PARCEL 1 A portion of the SWa of Section 31 Township 20 South of Range 64 West of the 6th P.M. described as follows: BEGINNING at a point on the South line of the Southwest quarter of Section 31, Township 20, Range 64 West, 405.8 feet West of the Southeast corner of said quarter section: thence Northwesterly at an angle of 37 0 40' to the right for a distance of 108 feet; thence to right on a curve of radius of 320.8 feet for a distance of 84 feet, to a point on the East line of the property of the Pueblo Smelting and Refining Company; thence Southerly on said East line of said property of the Pueblo Smelting and Refining Company and its production for a distance of 126.8 feet, to a point on the South line of the South -West quarter of Section 31, Township 20, Range 64 West; thence East on said South line for a distance of 120.8 feet to POINT OF BEGINNING. PARCEL 2: A portion of the NE4NE;NW4 Section 6, Township 21 South, Range 64 West described as follows: A strip of land about 78 feet wide and extending from the North line thereof to the East line thereof and bounded on the South and West by the right -of -way of The Union Pacific, Denver and Gulf Railway and on the North and East by the following described tract of land to wit: BEGINNING at a point on the North line of said Section 6, 405.8 feet West of the Northeast corner of the Northwest quarter of said Section 6; thence Southeasterly at an angle of 37 °40' 244 feet; thence to left on a curve of radius of 320.8 feet for a distance of 240 feet to the East line of said Northwest quarter of Section 6; thence North on said East line of Section 6, 212 feet to the Northeast corner of said Northwest quarter of Section 6; thence West on the North line of said Section 6, 405.8 feet to POINT OF BEGINNING. PARCEL 3 A portion of the Nh of Section 6, Township 21 South, Range 64 West of the 6th P.M. described as follows: BEGINNING at a point on the N/S Center line of Section 6, 385 feet South of the NE corner of the NW4 of said Section 6, thence in a Nally direction along the arc of a circle, the center being to the NELY with a radius of 528 feet, a distance of 475 feet; thence NW on a tangent to a curve, a distance of 157 feet, thence in a Nly direction along described arc of a circle, the center being to the NE with a radius of 767 feet, a distance of 121 feet to a point on the N. line of said Section 6, thence along the N. line of said Section through the N4 corner to intersection of said line and the W. R/W line of the Colorado and State Railroad, thence S 28 along W. line of said railroad to the NE corner of land conveyed to the Pueblo and State Line Railroad (Deed No. 103547), thence Wly curving to the right with a radius of 669.8 feet, a distance of 333.7 feet to point of tangency, thence N78 °38'W 138.8 feet to point on the Sly R/W line of the Pueblo Smelter Spur of the Colorado and State Railway, thence Wly along said R/W line curving to the right with a radius of 555 feet, a distance of 239 feet to the PLACE OF BEGINNING.
