A RESOLUTION ADOPTING AND APPROVING THE FINAL
WRITTEN PROPOSAL OF THE CITY OF PUEBLO TO THE
SOLE AND EXCLUSIVE BARGAINING AGENT FOR THE
CITY OF PUEBLO POLICE OFFICERS, INTERNATIONAL
BROTHERHOOD OF POLICE OFFICERS LOCAL 537 FOR
CALENDAR YEARS 1989, 1990 AND 1991
WHEREAS, the City of Pueblo and the International Brotherhood
of Police Officers Local 537 have failed to reach agreement on a
collective bargaining agreement to become effective January 1,
1989 within the time limits set by the City Charter; and
WHEREAS, the Charter of the City of Pueblo requires arbitra-
tion in such event and further requires that the corporate
authorities submit a final written proposal prior to such
arbitration; and
WHEREAS, the
City's 1988 annual
cost for
salary and the
following benefits
provided to police
officers in
the bargaining
unit with ten years
of service is:

WHEREAS, in addition to the above salary and benefits, each
police officer in the bargaining unit with 10 years of service is
entitled to: paid leave each year consisting of 18 days vacation,
10 days additional vacation in lieu of holidays, 2 days personal
leave, 18 days sick leave with an accrual of 190 days; overtime
compensation of one and one -half times regular salary; call back
compensation; one -year injury leave with full salary and benefits;
and if applicable, 4 days paid funeral leave, paid union business
leave, military leave, and educational incentives; and
WHEREAS, the budget for the Police Department has increased
to $8,640,764 for the year 1988 from $5,810,919 for the year 1978;
and
WHEREAS, the City Council finds and determines that the
salary and other benefits payable to members of the Police
Department are fair and reasonable; and
WHEREAS, a three year contract will eliminate the time,
turmoil and expense which has been involved in the negotiation and
arbitration process each year for the past several years; and
WHEREAS, the 1989, 1990 and 1991 budgets for the City of
Pueblo will require substantial expenditures in all areas of
essential public services, capital expenditures, and economic
development; and
WHEREAS, the City Council finds that for all of the above
reasons, fiscal responsibility requires that the City wage
proposal for calendar years 1989, 1990 and 1991 for each member of
the bargaining unit represented by the police union be limited to
the following increases; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:

The final written proposal of the City of Pueblo to the

International Brotherhood of Police Officers Local 537 for
calendar years 1989, 1990 and 1991 is:
ARTICLE 22. TERM OF AGREEMENT
This Agreement shall become effective January 1, 1989
and all of its provisions shall remain fully effective
through December 31, 1991.
ARTICLE 27. SALARY
The basic rate of pay established by ordinance for 1988
for each member of the bargaining unit shall be increased by
$165 per month as follows: $50 per month beginning January 1,
1989; $55 per month beginning January 1, 1990; and $60 per
month beginning January 1, 1991.
ARTICLE 33.1 HEALTH INSURANCE
Sections 33.1.1 and 33.1.2 are deleted and replaced by
the following:
The City shall contribute on behalf of each employee in
the bargaining unit the following maximum monthly amount
toward the actual cost of an employee's membership in a
health benefit plan such as Blue Cross Custom Plus covering
such employee:
(a) For an individual membership $75.00; or
(b) For a family membership $185.00.
The health benefit plan will provide hospital and
surgical benefits. Major medical coverage will have the
following maximum deductibles and coinsurance:

(a) Under an individual membership, $100.00 deductible
and $400.00 coinsurance.
(b) Under a family membership, $200.00 deductible and
$800.00 coinsurance.
The City and Union will form a committee composed of two
designated representatives of the Union and two designated
representatives of the City to meet and confer in the deter-
mination of the benefits to be provided and cost - containment
provisions to be included under such employee health benefit
plan and for the selection of the provider of such benefits.
If the committee is unable to agree in a timely manner as to
such benefits, cost - containment provisions, and /or provider,
the City reserves the right to determine and select such
benefits, cost - containment provisions, and /or provider. If
an employee lives outside the service area of the bargaining
unit, the City reserves the right to pay directly to such
employee the City's contribution toward the cost of member-
ship in such health benefit plan and such employee shall not
be covered thereunder.
All other provisions of the current collective bargaining
agreement shall remain unchanged, except for the following changes
agreed upon by the parties during the 1988 negotiating sessions:
Article 12, Uniform Allowance; Article 17, Discipline Procedures;
Article 18, Grievance Procedures; Article 30, Training; Article
32, Corporal Appointments; Article 35, Education Incentive;
Article 37, Ordinance Technicians; and Article 40, Funeral Leave.
