HomeMy WebLinkAbout6093RESOLUTION NO. 6093 A RESOLUTION GRANTING EASEMENTS TO THE COLORADO INTERSTATE GAS COMPANY ACROSS CITY -OWNED LAND AT THE PUEBLO MEMORIAL AIRPORT INDUSTRIAL PARK WHEREAS, the City of Pueblo has requested that Colorado Interstate Gas Company relocate portions of their high - pressure gas main at the Pueblo Memorial Airport Industrial Park; and WHEREAS, it is necessary for easements to be granted to the Colorado Interstate Gas Company along the new alignments for the purpose of construct- ion, operation and maintenance of the new high - pressure gas main; now, there- fore, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: The Easement Agreement, the original of which is on file in the office of the City Clerk and is made a part hereof by reference, by and between Pueblo, a Municipal Corporation, and the Colorado Interstate Gas Company, is hereby approved. TRACT 2 Sections Twenty -five (25) and Twenty -six (26), Township Twenty (20) South, Range Sixty -four (64) West, Pueblo County, Colorado, the centerline of said right of way and easement, fifty (50) feet in width, described as follows: Beginning at a point in the SW 1/4 of Section 25 -20S- 64W, Pueblo County, Colorado, which point of beginning bears North 59 East 2906.39 feet from the Southwest corner of said Section 25; Thence, with and along the centerline of said right of way and easement, 50 feet in width, South 15 West 10 feet to a point; Thence South 2 East 479.74 feet to a point; Thence South 52 West 659.26 feet to a point; Thence South 87 West 2014.03 feet to the point of intersection with the East line of Section 26- 20S-64W, which point is 497.24 feet in a Northerly direction with and along said East line from the Southeast corner of said Section 26; Thence continuing South 87 West 576.27 feet to a point; Thence South 89 West 4637.02 feet to a point; Thence North 47 West 85.45 feet to a point; Thence North 0 West 2923.15 feet to the point of termination, which point of termination bears North 2 West 789.34 feet from the West quarter corner of said Section 26 -20S -64W. CIG shall bury the top of its pipe at least Forty (40) inches below the surface of the ground. Pueblo, its successors and assigns, reserve all oil, gas, and minerals on and under said lands and the right to farm, graze and otherwise fully use and enjoy said lands, provided, however, BQOK2368 PAGf!�34 that CIG shall have the right hereafter to cut and keep clear all trees, brush and other obstructions that may injure, endanger or interfere with the construction and use of said pipeline, or fittings, tie - overs, and appliances appurtenant thereto. CIG shall have all privileges necessary or convenient for the full use of the rights herein granted, together with ingress and egress along said pipeline, and over and across said lands. CIG, by the acceptance hereof, agrees to pay for damages to crops, pasture, fences and timber, and other surface and improvement damages which may arise from maintaining, operating, repairing, replacing, or removing said pipeline. TO HAVE AND TO HOLD said right of way and easement unto said CIG, its successors and assigns, until such pipeline be constructed, and so long thereafter as a pipeline is maintained thereon; and the undersigned hereby bind themselves, their successors and assigns, to warrant and forever defend all and singular said right of way and easement unto said CIG, its successors and assigns, against every person whomsoever lawfully claiming or to claim the same, or any part thereof. It is agreed that this right of way grant as written covers all of the agreements between the parties and that no other representations have been made modifying, adding to, or changing the terms of the same.
