A RESOLUTION CALLING A SPECIAL MUNICIPAL
ELECTION FOR TUESDAY, SEPTEMBER 15, 1987 UNDER
SECTION 8 -14(k) OF THE CHARTER RELATING TO
COLLECTIVE BARGAINING - IMPASSE ELECTIONS
WHEREAS, the City and the three unions which represent the
classified employees of the City have not reached agreement on
City employee wage increases for 1988; and
WHEREAS, the City Charter requires that such impasse be
submitted to a vote of the people at an election to be held not
less than 30 days nor more than 90 days after receipt of the
arbitrators' recommendations; and
WHEREAS, the City's annual cost including its offer for
salary increase commencing January 1, 1988 and the following
benefits provided to typical classes of employees in the NAGE
bargaining unit with ten years of service is:

WHEREAS, in addition to the above salary and benefits, each
employee in the NAGS bargaining unit with 10 years of service is

entitled to: paid leave each year consisting of 18 days vacation,
10 days of paid holidays, 2 days paid personal leave, 18 days paid
sick leave with an accrual of 200 days including a maximum pay -off
for 120 days upon retirement or death; overtime compensation of
one and one -half times regular salary; call back compensation; one
year injury leave with full salary and benefits; and, if applica-
ble, 5 days paid funeral leave, paid union business leave,
military leave, and educational incentives; and
WHEREAS, in addition to the above salary and benefits, each
police officer in the bargaining unit with 10 years of service is
entitled to: paid leave each year consisting of 18 days vacation,
10 days additional vacation in lieu of holidays, 2 days personal
leave, 18 days sick leave with an accrual of 190 days including a
maximum pay -off for 120 days upon retirement or death; overtime
compensation of one and one -half times regular salary; call back
compensation; one -year injury leave with full salary and benefits;
and, if applicable, 4 days paid funeral leave, paid union business
leave, military leave, and educational incentives; and
WHEREAS, in addition to the above salary and benefits, each
fire fighter in the bargaining unit with 10 years of service on a
twenty -four hour shift schedule is entitled to: paid leave each
year consisting of 8 twenty -four hour shifts vacation, 6 twenty -
four hour shifts additional leave in lieu of holidays, 8 -1/2
twenty -four hour shifts sick leave with an accrual of 84 twenty -
four hour shifts including a maximum pay -off for 56 shifts upon
retirement or death; overtime compensation of one and one -half
times regular salary; call back compensation; one year injury

leave with full salary and benefits; and, if applicable, paid
funeral leave, paid union business leave, military leave, and
educational incentives; and
WHEREAS, the City Council finds and determines that the
salary and other benefits payable to members of the classified
service are fair reasonable; and
WHEREAS, the budget for the Police Department has increased
to $8,468,571 for the year 1987 from $5,177,452 for the year 1977;
and
WHEREAS, the budget for the Fire Department has increased to
$5,931,046 for the year 1987 from $2,945,271 for the year 1977;
and
WHEREAS, the NAGE union has adopted the arbitrator's recom-
mendation for a 6% salary increase January 1, 1988, additional
health insurance premiums plus other significant concessions; and
WHEREAS, the fire fighters' union has adopted the arbitra-
tor's recommendation for a 3% salary increase January 1, 1988 plus
a 3% increase July 1, 1988; and
WHEREAS, the police officers' union has adopted the arbitra-
tor's recommendation for a 4% salary increase January 1, 1988 plus
other concessions; and
WHEREAS, the City Council finds that salary increases of the
magnitude sought by the three unions and recommended by the
outside arbitrators are not justified and, if granted, may require
cutbacks in services or a tax increase; and
WHEREAS, the additional cost to the City of the arbitrators'
recommendations over the City proposal is in excess of $520,000 in

the year 1988 and in each year thereafter; and
WHEREAS, the 1988 budget for the City of Pueblo will require
substantial expenditures in all areas of essential public
services, capital expenditures, and economic development; and
WHEREAS, the City Council finds that for all of the above
reasons, fiscal responsibility requires that the City wage
proposal for calendar year 1988 for each employee be limited to an
increase of $45.00 per month; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:

A special municipal election is hereby called under Section
8 -14(k) of the Charter relating to collective bargaining - impasse
election for Tuesday, the 15th day of September, 1987.
SECTION 2
There is hereby submitted to a vote of the qualified electors
of the City of Pueblo at said special election the following
proposals: (a) Police Officers - the arbitrator's recommendations
of June 19, 1987, which recommendations were accepted by the
Union, and the final written proposal of the City made not less
than 10 days prior to the start of advisory arbitration
proceedings, (b) Fire Fighters - the arbitrator's recommendations
of July 22, 1987, which recommendations were accepted by the
union, and the final written proposal of the City of Pueblo made
not less than 10 days prior to the start of advisory arbitration
proceedings, (c) Other Classified Employees - the arbitrator's
recommendations of July 9, 1987, which recommendations were
accepted by the union, and the final written proposal of the City

of Pueblo made not less than 10 days prior to the start of
advisory arbitration proceedings.

The City Council hereby finds and determines that voting
machines are not available for said special election. The votes
on the proposals shall be registered by the use of electronic
voting equipment and punch card ballots which will permit each
qualified elector to record his votes and be counted by electronic
tabulating equipment.
SECTION 4
The special election shall be held during the same hours and
polling places as general municipal elections and shall be con-
ducted and the returns thereof made in the same manner and by the
same officers of elections who act in like capacity as to general
municipal elections. Votes cast at the special election shall be
canvassed and the results ascertained, determined and certified in
the same manner and at the same times and by the same officials
who perform like functions as to general municipal elections. The
City Clerk and other City officials who are required to conduct
elections, make publication and give notice in respect of the
submission of any proposal to the electors at a general municipal
election shall give all requisite notices and make all requisite
publication of the proposals hereby submitted to a vote of
qualified electors of the City of Pueblo at said special municipal
election at the same time and in the same manner as a general
municipal election.

The proposals submitted to a vote of the qualified electors
of the City of Pueblo on punch card ballots will be in substan-
tially the following form:
POLICE OFFICERS
(Vote For Only One Of The Following Proposals)
PROPOSAL NO. 1. Arbitrator's recommendations accepted by the
International Brotherhood of Police Officers, Local 537, which
generally provide:
4% annual salary increase for each employee on January 1,
1988; option of diverting up to $60 per month of uniform
allowance to pay health insurance premiums; City to pay the
full cost of family coverage of health and dental insurance
for police officers whose spouses are also employed by the
City.
FOR PROPOSAL NO. 1. (an elector desiring to vote for
Proposal No. 1 should indicate his vote by punching the
ballot card where indicated)
PROPOSAL NO. 2. City of Pueblo's final written proposal, which
generally provides:
$45.00 a month salary increase for each employee starting
January 1, 1988.
FOR PROPOSAL NO. 2. (an elector desiring to vote for
Proposal No. 2 should indicate his vote by punching the
ballot card where indicated)
FIRE FIGHTERS
(Vote For Only One Of The Following Proposals)
PROPOSAL NO. 1. Arbitrator's recommendations accepted by the
International Association of Fire Fighters Local #3, which
generally provide:
6% annual salary increase for each employee, 3% on January 1,
1988 and 3% on July 1, 1988.

Proposal No. 1 should indicate his vote by punching the
ballot card where indicated)

generally provides:

OTHER CLASSIFIED EMPLOYEES
(Vote For Only One Of The Following Proposals)
PROPOSAL NO. 1. Arbitrator's recommendations accepted by the
National Association of Government Employees, Local R9 -45, which
generally provide:
6% annual salary increase for each employee on January 1,
1988; the City to pay the full cost of an individual health
insurance policy or 90% toward the cost of a family policy
depending upon the coverage which an employee elects;
increase tool allowance to $190 per year; transfer to
vacancies be awarded on the basis of seniority except where
the City can demonstrate reasonable cause for not filling the
vacancy on such basis; if financial hardship exists, an
employee may be granted the equivalent in money of up to 10
shifts or 10 days of vacation leave to which such employee is
entitled for that year; and full step -up pay after 30 days in
a higher class.

PROPOSAL NO. 2. City of Pueblo's final written proposal, which
generally provides:

SECTION 6
This Resolution shall become effective upon final passage.
