A RESOLUTION APPROVING AN AGRM=r BETWEEN THE CITY OF PUEBLO
AND ABEL J. TAPIA DBA, ABEL ENGINEERING PROFESSIONAIS FCR
ENGINEERING SERVICES RELATING TO THE INVESTIGATION, DESIGN AND
INSPECTION OF PROPOSED IAPRDVEMENTS ON THE LANDFILL LOCATED AT
PUEBLO NIBMIAL AIRPORT, AND AUTHORIZING TIC CITY MANAGER TO
EXECUTE THE SAME,
WBEREAS, The City desires to retain a Consultant to provide the
Engineering Services necessary for the investigation, design and inspection
of proposed improvements on the Landfill located at Pueblo Memorial Airport;

SECTION I
A certain Agreement to perform Engineering Services for the City of
Pueblo for the investigation, design and inspection of proposed improvements
on the Landfill located at Pueblo Memorial Airport for the period June 30,1987
to June 30, 1988, a copy of which is attached hereto and made a part hereof
by reference, after having been approved as to form by the City Attorney,
by and between the City of Pueblo, a Municipal Corporation, and Abel J. Tapia
dba, Abel Engineering Professionals, United Bank Building, Suite 300, Pueblo,
Colorado, be and the same is hereby approved.

The City Manager is hereby authorized to execute said Agreement on
behalf of the City of Pueblo, a Municipal Corporation, and the City Clerk
shall affix the Seal of the City thereto and attest the same.

CONTRACT FOR ENGINEERING SERVICES
THIS CONTRACT, made and executed in duplicate this 27thday
of July 1987, by and between the City of Pueblo, A
MUNICIPAL CORPORATION, hereinafter called the "City" party of
the first part, and Abel J. Tapia dba, ABEL ENGINEERING
PROFESSIONALS, hereinafter called the "Engineer" party of the
second part; WITNESSETH THAT in consideration of the mutual
covenants herein contained, the City agrees to employ the
Engineer to perform the services hereinafter outlined, and
agrees to pay them for such services according to the
schedule of fees herein contained.
SECTION I
The services which the Engineers agree to perform are
those appertaining to the engineering services necessary for
the investigation, design and inspection of the proposed
improvements on the Airport Landfill as outlined in a
"Proposal for the Pueblo Memorial Airport Landfill
Engineering Project" dated April 28, 1987, hereafter called
"Proposal."

To accomplish the aforegoing, the Engineer will
perform the services as outlined in Exhibit "A," attached
hereto and incorporated herein in accordance with all
applicable laws rules and regulations. The service will
commence June 30th 1987 and be satisfactorily and
professionally accomplished by June 30th 1988. Any
modification of design alternative chosen by the City may
alter the Scope of Service, Exhibit A. Should the Scope of
Service vary considerably it is to be considered acceptable
for the City and Engineer to negotiate a Change Order to
adjust quantities of involvement either to increase or
decrease a quantity.

SECTION II
Compensation shall be by monthly progress payments equally to
the time and materials actually expended during each monthly
period expressed as a percent of completion of each item.
The monthly request for payments must be approved by the
Director of Aviation. The construction and consulting phases,
Items 8 10, 11 as indicated in this Section shall be on an
hourly or as requested basis. The hourly rates are as
indicated in Exhibit B. For items of Service where
negotiation of Change Orders is accomplished, the schedule of
Time and Materials Rates (Exhibit "B ") shall be used.
For the services as outlined in Exhibit A, the City
agrees to pay the Engineer the amounts not to exceed the
following schedule of fees:

SECTION III
The Engineer will employ one consulting organization in
association with its staff in the performance of special
portions of the work as outlined in the "Scope of Services."
This firm is Terra Consultants, Inc.
It is agreed and understood that the Engineer shall not
further assign or transfer their interest in the Agreement,
or any part thereof, without the written consent of the City.
In event of death or incapacitation of a substantial portion
of supervisory personnel of the Engineer, or failure of the
engineer to-preform services in a timely or professional
manner, the City may terminate the Agreement by written
notice to the Engineers, the payment to be paid as far as
possible, on the fee as established in the Agreement cannot
be applied, then the basis shall be the Engineer's cost as
set forth in Exhibit B for all the time actually and
necessarily consumed under this Agreement.

SECTION IV
The City and the Engineers each bind themselves, their
successors, executors, administrators and assigns, to the
other party of this Agreement and to their successors,
executors, administrators and assigns of such other party in
respect of all covenants of the Agreement. Engineer shall
maintain General Liability Insurance in the amount not less
than $ 300,000.00 and Workmans Compensation Insurance as
required by Colorado Statutes and provide certificates
thereof to the City .

1. REVIEW CURRENT CERTIFICATE OF DESIGNATION AND ALL
APPROPRIATE REGULATION TO EVALUATE COMPLIANCE TO
RECOMMEND CORRECTIVE ACTION.
