RESOLUTION NO. 6055
A RESOLUTION ACCEPTING PROPERTY FROM
ASCENSION ENTERPRISES FOR A SANITARY SEWER
EASEMENT
WHEREAS, Ascension Enterprises, a Limited Partnership, on
June 6, 1987, granted a sanitary sewer easement to the City of
Pueblo; and
WHEREAS, such easement is necessary to serve Special
Improvement District No. 86 -1 and has been approved as to form by
the City Attorney.
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1.
The easement granted by Ascension Enterprises, a Limited
Partnership, dated June 6, 1987, which easement is on file with
the City Clerk, is hereby approved and accepted.
SECTION 2
The City Clerk is directed to record said easement and a
certified copy of this resolution in the office of the Pueblo
County Clerk and Recorder.

E A S E M E N T
THIS EASEMENT, granted this to day of June, 1987, by ASCENSION
ENTERPRISES, a Limited Partnership, Grantor, to PUEBLO, a Municipal
Corporation, Grantee:
W I T N E S S E T H:
IN CONSIDERATION of the waiver by the Grantee of any and all annexation
fees which may normally be assessed by Grantee for the annexation of Grantor's
adjacent land consisting of approximately 78 acres, and the sum of $1.00 and
other good and valuable consideration, paid by Grantee, receipt of which is
hereby acknowledged, Grantor hereby grants to Grantee, its successors and
assigns, easements for the purpose of sanitary sewer lines, in, through, over,
under and across Grantor's property situated in Pueblo County, Colorado. Said
easements are described in Exhibit "A ", which is attached hereto and
incorporated herein. t
TOGETHER WITH the right to enter upon said property for the purpose of
construction, maintenance, control, and repair. Should Grantee need temporary
access for Grantor's adjacent property for construction purposes, Grantee
shall request same from Grantor and Grantor agrees not to unreasonably
withhold Grantor's consent to same. Grantor reserves the right to use and
occupy said property for any purpose consistent with the right and privilege
above granted and which will not interfere with or endanger any of the
Grantee's equipment or facilities therein or use thereof. Such reservation by
Grantor shall not include the right to locate or erect or cause to be located
or erected any building or any other structure or manufactured home or trailer
upon the easement herein granted.
"Grantee" shall include the plural and the feminine. This Easement shall
be binding upon, and shall inure to the benefit of the heirs, personal
representatives, successors and assigns of the Grantor and Grantee.

A strip of land located in a tract of land platted and described as the
remaining acreage of the subdivision variance request, according to the re-
corded plat thereof, filed for record in Book 2044 at Page 804 of the Pueblo
County Records, and being more particularly described as follows:
Considering the line between the City monuments at the inter-
section of Beech and Portland and the intersection of Ash and Port-
land to bear due North - South, and all bearings contained herein being
relative thereto.
EASEMENT N0. 1
A strip of land being 20.0 feet wide, measured 10.0 feet each side of
the following described centerline:
Beginning at a point which is the intersection of the centerline of Queens
Avenue and the south right of way line of Beech Street as platted in Wiley and
Chamberlins Subdivision, according to the recorded plat thereof; Thence S.00
00 East along the centerline of said Queens Avenue extended, a distance
of 171.51 feet to point of terminus, said point being 15 feet northerly of
and measured in a normal distance to the southerly line of said subdivision
variance request plat.
EASEMENT N0. 2 '
A strip of land being 30.0 feet wide, measured 15.0 feet each side of the
following described centerline:
Commencing at the southwest corner of said subdivision variance request
plat; Thence N. 00 E. along the west line of said plat, said line also
being the East right of way line of Portland Avenue as platted in Wiley and

Chamberlin's Subdivision, according to the recorded plat thereof, a distance
of 94.62 feet to the point of beginning for this description; Thence N. 89
38" E., a distance of 471 feet more or less, to a point being 15 feet northerly

of and measured in a normal distance to the southerly line of said subdivision
variance request plat; Thence N. 80 E. and parallel with said southerly
line, a distance of 1581.05' to the beginning of a curve to the left; Thence
Northeasterly along the arc of said curve, whose radius is 2775 feet, a dis-
tance of 90.85 feet; Thence N. 00 W., a distance of 1237.59 feet to
point of terminus, said point being on the Northerly boundary of said subdivi-
sion variance request plat and also being on the South right of line of 2nd
Street as platted in Plat No. 1 of V.G. Hills Arbitrator, according to the
recorded plat thereof, and 37.27 feet East of the West right of way line of
Harrison Avenue as platted in said Plat No. 1 of V.G. Hills Arbitrator.

A strip of land being 20.0 feet wide, measured 10.0 feet each side of the
following described centerline:
Commencing at the,_,Morthwest corner of Trinity Subdivision, according to
the recorded plat thereof; Thence S. 01 west along the west line of
said Trinity Subdivision, said line also being the west right of way line of
Vision Lane as platted in said Trinity Subdivision, a distance of 211.59 feet
to the beginning of a curve to the left; Thence Southerly along the arc of
said curve, whose radius is 1143.80 feet, a distance of 122.86 feet to the
point of beginning for this description; Thence N. 88 W., a distance of
1,500.65 feet to point of terminus, said point being on the Westerly line of
said subdivision variance request plat, and also being N. 01 E., a dis-
tance of 20.41 feet from the right of way line of 2nd St., as platted in
Plat No. 1 of Y.G. Hills Arbitrator, according to the recorded plat thereof.
