HomeMy WebLinkAbout6030RESOLUTION NO. 6030 A RESOLUTION AUTHORIZING THE ISSUANCE OF A PERMIT TO COLORADO INTERNATIONAL AIRSHOW FOR PURPOSES OF CONDUCTING AN AIRSHOW AT PUEBLO MEMORIAL AIRPORT WHEREAS, the City Council wishes to provide support to the Pueblo 1987 Airshow; and WHEREAS, the City Council recognizes the importance of the Airshow to the Community and non - profit organizations within the Community. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PUEBLO, COLORADO, that: SECTION 1: A permit be issued to Colorado International Airshow to use property and facilities at Pueblo Memorial Airport in accordance with the provisions of the Agreement For Permit dated June 8, 1987, which Agreement is attached hereto and incorporated herein. SECTION 2: The Agreement For Permit dated June 8, 1987, is hereby approved for the period July 4 through July 5, 1987 and the President of the City Council is authorized to execute the same for and on behalf of the City. INTRODUCED June 8 , 1987 BY ALLYN MTDDP.T,KAMP Councilman APPROVED: ATTEST: City' Clerk Pre dent of the Council AGREEMENT FOR PERMIT This Agreement made this 8th day of June, 1987, by and between the CITY OF PUEBLO, A MUNICIPAL CORPORATION, hereinafter referred to as "CITY" and COLORADO INTERNATIONAL AIRSHOW, hereinafter referred to as "PERMITTEE ". W I T N E S S E T H WHEREAS, the City Council is authorized, pursuant to Section 3 -1 -2 of the Code of Ordinances, to grant permits for commercial operations at Pueblo Memorial Airport, and WHEREAS, Permittee acknowledges and agrees that the exercise of any of the privileges granted herein is subject to and constitutes acceptance of all the conditions of this Agreement and permit. NOW THEREFORE, in consideration of the foregoing and mutual promises herein contained the parties agree as follows: 1. Permittee is hereby granted permission to use, for the purpose of pre- senting an airshow, property and facilities at Pueblo Memorial Airport (herein "Property "). The Property to be used by the Permittee will be mutually designated and determined by Permittee and City. 2. Permittee acknowledges and agrees that in no event will Permittee place, locate, erect, or cause to be placed, located or erected any building, structure, fence, stands, signs, or improvements upon the Property, unless done so in compliance with all Resolutions, Ordinances, Rules and Regulations of the City and all federal, state, and county laws and regulations applicable thereto or to Permittees activities conducted thereon. 3. Permittee acknowledges and agrees Permittee will acquire all necessary FAA permits, waivers, or approvals required or necessary for the safe presentation of Permittee's airshow and all activities to be conducted on the Property by Permittee. 4. Permittee shall maintain the Property in a safe, orderly, clean and sanitary condition, and in compliance with all City ordinances, rules and regulations. 5. Permittee shall exercise due diligence in protection from damage or injury the Property and all persons thereon. 6. Permittee agrees to indemnify and hold harmless the City, its agents and employees, from and against any and all claims, actions, expenses, including reasonable attorney fees, liabilities or loss based upon damage to property or injury to or death of persons, caused by or arising, directly or indirectly, out of the use of the Property by Permittee, its officers, agents, employees, participants or invitees, or Permittee's activities conducted thereon, or the violation of any statute, ordinance, rule or regulation. 7. This Agreement and permit hereby issued is for the period of July 4 through July 5, 1987, at which time this Agreement and permit shall terminate. Permittee shall within twenty -four (24) hours after the conclusion of the Airshow, on July 5, 1987, at its sole expense, remove all signs, stands, struc- tures or improvements placed thereon by Permittee or with Permittee's per- mission and restore the Property to its original condition. All trash, bottles, cups, and other debris shall be removed from the Property. If Permittee fails to remove all signs, stands, structures, improvements or debris within twenty -tour (24) hours, the City may, at its option, remove or cause same to be removed at the cost of the Permittee. 8. Neither this Agreement nor the permit hereby granted is transferable. 9. Permittee shall maintain at its expense during the effective period of this Agreement and permit the following insurance coverage and provide City with Certificates therefor: A. Comprehensive general liability insurance in amounts not less than $5,000,000 each occurrence, covering the activities to be conducted on the Property by the Permittee and spectators thereof as well as contractual liability. B. Workmen's Compensation insurance as required by the laws of the State of Colorado. IN WITNESS WHEREOF, the parties have caused this Agreement to be duly approved and executed as of the date first written above.
