SUBJECT: AN ORDINANCE APPROVING AND ACCEPTING A GRANT
AGREEMENT FOR THE CITY OF PUEBLO FROM THE COLORADO
HEALTH FOUNDATION, AUTHORIZING THE MAYOR TO EXECUTE
THE SAME, ESTABLISHING PROJECT NO. CI2458, AND BUDGETING
AND APPROPRIATING FUNDS IN THE AMOUNT OF $545,457.00 TO
PROJECT NO. CI2458
SUMMARY:
This Ordinance approves and accepts a grant awarded from The Colorado Health
Foundation in the amount of $545,457.00 for the Benedict Park Community Co-Created
Outdoor Play Space project.
PREVIOUS COUNCIL ACTION:
Not applicable to this Ordinance.
BACKGROUND:
This year, the City applied for a grant from The Colorado Health Foundation to
implement the community co-created design for an outdoor play and gathering space at
Benedict Park. The community design process was supported through a robust and
thoughtful community engagement process that has progressed to and informed the
conceptual design for the play space.
On December 5, 2024, the City was notified that The Colorado Health Foundation
designated the City of Pueblo to be awarded the 12-month grant in the amount of
-safe surface with
lights, new perimeter fence, multi-use pathway through park with lighting, concrete
chess table and seating, resurface basketball court (half court), new basketball baskets,
skateboarding bowl, new trees, planting beds and irrigation, two-level water fountain,
and park signage.
FINANCIAL IMPLICATIONS:
There is no match for this grant. The Colorado Heath Foundation, per the terms of the
grant agreement, will cover the cost of the project.

Not applicable to this Ordinance.
STAKEHOLDER PROCESS:
Not applicable to this Ordinance.
ALTERNATIVES:
Should the Council choose not to approve this grant agreement, much needed
improvements to Benedict Park will not be made and other funding sources must be
found.
RECOMMENDATION:
Approval of the Ordinance.

ORDINANCE NO. 10880
AN ORDINANCE APPROVING AND ACCEPTING A GRANT
AGREEMENT FOR THE CITY OF PUEBLO FROM THE
COLORADO HEALTH FOUNDATION, AUTHORIZING THE
MAYOR TO EXECUTE THE SAME, ESTABLISHING PROJECT
NO. CI2458, AND BUDGETING AND APPROPRIATING FUNDS
IN THE AMOUNT OF $545,457.00 TO PROJECT NO. CI2458
WHEREAS, The Colorado Health Foundation has tendered a grant award in the total
amount of $545,457.00 upon conditions recited therein or incorporated therein by reference;
and
WHEREAS, WHEREAS, acceptance of the funding for the purposes for which it has
been made is in the best interest of the City and will benefit the health, welfare, and safety of the
citizens of the City; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Grant Agreement, Benedict Park Community Co-Created Outdoor Play Space,
between the City of Pueblo, a Colorado Municipal Corporation, and The Colorado
Health Foundation, a copy of which is attached hereto, having been approved as to form by the
City Attorney, is hereby approved.
SECTION 2.
The Mayor is hereby authorized to execute the Agreement in the name and on behalf of
the City of Pueblo, where the Mayor may execute the Agreement by electronic signature and
such electronic signature shall be attributable to the Mayor and the City of Pueblo.
SECTION 3.
Project No. CI2458 Benedict Park Community Co-Created Outdoor Play Space Project
is hereby established.
SECTION 4.
The grant award from The Colorado Health Foundation, totaling $545,457.00 is hereby
approved and accepted in accordance with the Agreement.
SECTION 5.
All funds accepted pursuant to this Ordinance shall be budgeted and appropriated into
Project No. CI2458. Said funds shall only be expended and used for this project.
SECTION 6.
Pursuant to the Agreement, The Colorado Health Foundation, may unilaterally amend
the terms of the Agreement or the amount of grant funds pursuant to an Option Letter or Grant
Funding Change Letter. In the event The Colorado Health Foundation increases the grant
award via such a letter, the additional funds may be accepted pursuant to this Ordinance and
budgeted and appropriated into Project No. CI2458, where said funds shall only be expended
and used for this project.
SECTION 7.
The officers and staff of the City are authorized to perform any and all acts consistent
with the intent of this Ordinance to implement the policies and procedures described herein.
SECTION 8.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.
