HomeMy WebLinkAbout15877RESOLUTION NO. 15877 A RESOLUTION APPROVING COMPENSATION WITH RESPECT TO LEGAL SERVICES AGREEMENT WITH BERG, HILL, GREENLEAF, RUSCITTI LLP BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. Compensation set forth in the Legal Services Agreement with Berg, Hill, Greenleaf, Ruscitti LLP, a copy of which is attached hereto, is hereby approved. SECTION 2. The officers of the City are authorized to perform any and all acts consistent with the intent of this Resolution to effectuate the policies and procedures described herein. SECTION 3. This Resolution shall become effective immediately upon final passage. PREVIOUS COUNCIL ACTION: Not applicable. BACKGROUND: Pursuant to Section 6-7 of the City Charter, special council is retained solely by the City Attorney but compensation is approved by City Council. The law firm of Berg, Hill, Greenleaf, Ruscitti LLP is being retained to advise City as to best course of action to including: - Review and advise with respect to th under federal law, state law and contract to maintain or repair the gunite lining; - With respect to any such duty, review and advise as to available remedies including mandamus and/or tort claims for seepage or overflow and potential defenses including limitation of action. - Review and advise as to the appropriate venue for any legal action including whether same be filed in federal court given that the maintenance obligation that is set forth in law arises in part under federal law. - Review and advise as to the potential cost of such litigation and likelihood of success of such litigation. FINANCIAL IMPLICATIONS: This firm's hourly rate for this engagement is Partners $345.00 / hour, Special Counsel / Senior Associates $295.00 / hour and Paralegals $160.00 / hour. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Resolution. STAKEHOLDER PROCESS: Not applicable to this Resolution. ALTERNATIVES: Not approve Resolution.
