A RESOLUTION APPROVING AN AGREEMENT BETWEEN
NEIGHBORHOOD HOUSING SERVICES OF PUEBLO, INC.,
DBA NEIGHBORWORKS OF SOUTHERN COLORADO, INC., A
COLORADO NON-PROFIT CORPORATION AND THE CITY OF
PUEBLO, A COLORADO MUNICIPAL CORPORATION, FOR
THE CONVEYANCE OF PROPERTY, AND AUTHORIZING THE
MAYOR TO EXECUTE SAME
WHEREAS, On November 10, 2014, City Council adopted Resolution No. 13099
approving the transfer of a City owned property to NeighborWorks of Southern Colorado for low-
moderate income housing development.
WHEREAS, NeighborWorks of Southern Colorado is unable to use the property for the
intended use, due to environmental hazards present; Now, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that
SECTION 1.
The City Council hereby finds and determines that the property described as Lots 27 +
28 Blk 34 Minnequa Heights also known as 2709 Spruce Street, Pueblo, CO 81004, is unable to
be utilized by NeighborWorks of Southern Colorado as the intended purpose when the deed
was conveyed on November 10, 2014.
SECTION 2.
The Mayor is hereby authorized to execute the Agreement in the name and on behalf of
the City of Pueblo, where the Mayor may execute the Agreement by electronic signature and
such electronic signature shall be attributable to the Mayor and the City of Pueblo.
SECTION 3.
The officers and staff of the City are directed and authorized to perform any and all acts
consistent with the intent of this Resolution and the attached Agreements to effectuate the
transactions described therein.
SECTION 4.
If any section, paragraph, clause, or provision of this Resolution shall for any reason be
held to be invalid or unenforceable, the invalidity or unenforceability of such section, paragraph,
clause, or provision shall not affect any of the remaining provisions of this Resolution.
SECTION 5.
This Resolution shall become effective on the date of final action by the Mayor and City
Council.

SUMMARY:
This Resolution approves the transfer of property at 2709 Spruce Street from
NeighborWorks of Southern Colorado (NWSOCO) to the City of Pueblo.
PREVIOUS COUNCIL ACTION:
City Council adopted Resolution No. 13099 on November 10, 2014, approving the
transfer of a City owned property to NWSOCO for affordable housing development.
BACKGROUND:
At the time the City of Pueblo transferred the property to NWSOCO, it was located
within the boundaries of the Colorado Smelter Superfund Site. As a property within the
boundaries, environmental mitigation could be done at no cost to NWSOCO through a
program run by the Environmental Protection Agency (EPA). The final boundary, which
was determined after the time of deed conveyance from the City of Pueblo to
NWSOCO, did not include this property inside the boundary.
FINANCIAL IMPLICATIONS:
The City of Pueblo will be responsible for the ongoing maintenance of the property if the
deed is conveyed to the City.
BOARD/COMMISSION RECOMMENDATION:
Not Applicable.
STAKEHOLDER PROCESS:
Not Applicable.
ALTERNATIVES:
City Council can choose not to approve the Resolution, resulting in the ongoing
ownership of the property by NWSOCO.
RECOMMENDATION:
Approval of the Resolution.
