HomeMy WebLinkAbout5982RESOLUTICN NO. 5982 A RESOLUTION APPROVING AN AGREENMr BETWEEN THE CITY OF PUEBLO AND THE STATE DEPARDMTr OF HIGHWAYS, STATE OF COLORADO, FOR PROVIDING AND MAINTAINING LANDSCAPING OF SH 50-B AT THE PUEBLO MEMORIAL AIRPORT BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PUEBLO, COLORADO, THAT: SECTION 1. A certain Agreement, a copy of which is attached hereto and made a part hereof by reference, by and between Pueblo, A Municipal Corporation and the State Department of Highways, State of Colorado, for providing and maintaining the landscaping of SH 50-B Interchange Area at the Pueblo Memorial Airport in the County of Pueblo, be and the same is hereby approved. .I�. DMlitf The City Manager of the City of Pueblo is hereby authorized to execute said Agreement on behalf of Pueblo, A Municipal Corporation, and the City Clerk shall affix the Seal of the City of Pueblo thereto and attest the same. INTRODUCED March 23, 1987 BY PAUL JONES Councilman ..04 ATTEST ic��eAtf e City Council v Ci Clerk LETTER OF UNDERSTANDING This letter documents the understanding between the City of Pueblo and the Colorado Department of Highways for landscaping of the Pueblo Memorial Airport and State Highway 50-B Interchange. The following outlines that understanding. RESPONSIBILITIES CN THE PART OF THE CITY The City will, at no cost to the Department: 1. provide all landscape water and electricity for automatic irrigation controllers throughout the useful life of the Interchange, hereby determined to be 20 years; 2. assure installation of a cost- effective, low water usage, drip irrigation system in substantial conformance to the Department's irrigation design, plans, and specifications approved and provided by the Department; 3. furnish all parts and supplies to maintain and repair the irrigation system and provide replacement vegetation in the event of.disease, damage, or death; 4. water all vegetation and maintain the vegetation in a healty, attractive state; 5. trim and prune, inspect for insects and disease, and replace diseased, damaged, or dead plant materials in accordance with the directions and guidance of the City's horticultural expert; 6. repair, restore, or replace any damage to the property of the Department, including the highway and its appurtenances, caused by the negligence of the City; 7. abide by all State and Federal laws, rules, and regulations governing traffic control and safety; 8. hold the Department and State of Colorado harmless from any claim or damage or injury caused by the City, its contractors, and authorized agents in the performance of this Letter of Understanding, except for Workmen's Compnesation Claims by or on behalf of State mmployees or their heirs; 9. routinely inspect the irrigation system and make all necessary repairs; and, 10. provide expert guidance to the Department on the application of fertilizer and chemical treatments such as pesticides, fungicides and other sprays. RESPONSIBILITIES ON THE PART OF THE DEPA The Department will, at no cost to the City: 1. grant permission to the City, its contractor and agents to enter the property of the Department for the purposes outlined in this Letter of Understanding; The Department further understands that it must: 2. assure installation of landscape plant materials in substantial conformance to the design, plans and specifications provided by the Department; 3. provide to the City a complete set of plans, as constructed, showing the type, location, and other details of the installed plant materials and irrigation system; a complete maintenance manual including irrigation system testing procedures and landscape maintenance requirements; and other characteristics and details required for the inspection, maintenance, and repair ofthe irrigation system and landscaping; 4. perform all routine and normal highway maintenance functions including the repair or replacement of damaged lights, signs, and other highway appurtenances, except those damaged by the negligence of the City; 5. take all appropriate precautions to prevent damage to the vegetation; 6. weed and apply fertilizers and spray in accordance with the direction and guidance of the City's horticultural expert; 7. maintain landscape mulch, repair or replace any weed barrier fabric, periodically remove accumulated trash and debris, and repair erosion damage, and; 8. maintain landscape rock or cobbles or patterned concrete median cover, whichever is installed, in an attractive and safe condition. 2 This understanding may be te by either party upon 90 days prior written note.
